I797 are NOA's. Are you expecting a NOA2 sometime soon? This could be it as it is dated 4/5.

I am waiting on my NOA2.  No RFE’s prior to this and no status update except for when I received an email about the “notice explaining USCIS actions was mailed” on April 5th.

I am hoping to receive the official notice tomorrow or Friday.

Will a USCIS agent be able to tell me exactly what I am receiving in the mail?

Any update? Hoping for the best for you.

I accidentally replied to wrong comment but I haven’t received official notice in the mail (snail mail bites).  USCIS Automated System stated they sent me an I-797 notice of action.

It is ok. I hope you hear good news. Keep us posted. And try to call them and ask to speak with tier 2 and she or he would be able to tell you what you are expecting in the mail. Just ask them what is that I am receiving. Is that an approval? And they should be able to answer you. Good luck.

Typically they do not discuss cases. On an occasion some one have gotten a Tier Two Agent to explain what they see on their end. Sometimes if you are receiving a RFE you can get it faxed to you. I just depends.

I feel your pain. If only the automated messages were a little more detailed. This process lacks humanity and consideration for couples living far from each other. I'm sad to be far from my fiancé and feel like my life is on pause. I can't even plan a wedding without knowing when my fiancé would arrive.

It has been 7 months since he was in Houston with me.  We are both incredibly blessed with the technology to be able to video chat every single day.

We did receive a NOID because we stupidly failed to provide my passport photo and his letter of intent to marry me.  They just requested those two items to be mailed back ASAP.  I am going to mail it with priority so they receive in 1-2 days.

I hope everyone else gets good news soon!

What you received was a RFE. NOID is denial.

It certainly sounds like an RFE but the letter really did state intent to deny as the subject.

The full letter states RFE but I can't be sure. Intent to deny is a request for additional information , without case denied.

A NOID means that the government has reviewed your application package and found that although you provided enough initial evidence, you are nonetheless ineligible for the immigration benefit requested. The NOID will explain the reason why it was issued.

It would be a denial and wouldn't ask for additional evidence as your letter does.

I am sorry that you received a NOID. I don’t know why you didn’t receive a RFE instead. I hope they will accept your documents and changed their decision. I’m attaching a photo to show you the heading of the RFE I received. It explicitly states Request for Evidence.

So after re-reading my intent to deny letter it did end up being a RFE.  The return address specifically states:  ATTN: RFE.  I priority mailed it back to them so hopefully we get the good news soon!
