Hello members..

I only sent the i129f application forms without any evidence. I know.. that was stupid of me.. my question is.. can i send the evidence now since from Sept 11 they won't be requesting RFEs. My case was transferred to CSC. I was thinking of mailing the evidence to the centre. Any advice???

Do not send anything that is not requested. They receive millions of documents and it will be at risk of getting lost. Best to wait to hear back from them.

the evidence would likely never find your original file, or at least not until its too late.

wait for an RFE (best case scenario) or for a flat out denial (depending on what was missing). this was a MASSIVE error on your part.

I agree.  I would be greatly surprised if this one results in an RFE......i really don't understand how petitions get sent with zero evidence.

OP- I wouldn't send anything until I received the Communication from USCIS.

Just to clarify here, RFEs are not going away. This is an overreaction to recent changes. However, petitions with major components missing could be rejected outright and require a refile (which is not unreasonable). How yours will fall, only USCIS can decide that. Wait until you hear back from them to know what your next steps are.

Thanks so much for the reply. I know i messed up big time and I'm mentally preparing myself for a refile since my petition actually looks like a place-holder from uscis's perspective that's why i was thinking of just sending the evidence with the receipt no and case no included and wish for the best. 🤷🏾‍♀️ best case scenario; they accept it or reject it and send an RFE, worst case scenario; outright denial.

When I noticed an error I made on the I-130, I called USCIS to ask what I can do to correct it. They advised me to wait until I received the NOA1 then write a letter explaining what the error(s) were and send them to the PO box listed on the NOA1 (TSC). So maybe wait until you receive your NOA1(if you haven't already) and then send whatever evidence you forgot to send before, along with your receipt number of course.

No doubt, sorry if I wasn't clear there. I just wanted to correct the "there are absolutely no more RFE's" pandemonium that often creeps up in the forums. This case, yes, would surprise me if it gets an RFE instead of denial.

I completely agree and that is why I know @missileman and myself have been on here trying to clarify this for people. It is not that hard to understand once you look at it but most people just see the headline and go no further. If they need some type of evidence from a petition then they will issue a RFE but if the petitioner literally sent no evidence at all like the OP did then they will just deny it.

This is exactly the type of scenario that the 'new' rules are trying to eliminate.

It will likely be denied. Sending more info now likely wont help, theyll deny it before they even SEE your new info.

I'm not sure how you can send a petition with no evidence. its more than filling out a form and sending money. These types of 'errors' clog the 'lines' and make it slower for everyone.  They have to figure out you didn't know what you were doing when they COULD be working on the ones behind yours, who have their ducks in a row, so to speak. One case may not make a difference, but you're not the only one. it all adds up to longer processing times. All because people can't follow simple instructions.

As I said, you can HOPE for an RFE but if you sent NO evidence, it will be denied in all likelihood. And honestly rightfully so.

Just wait, resubmit, and send them more money.

Oh that was smart. I fail to understand how one makes that mistake. In order to know what forms to send you would have seen anywhere that you needed to send evidence. That’s basic stuff and I advise you to do a lot more research on this process if you want to continue.

You will not get an RFE. You will get a flat out denial. The new rules starting in September are to get rid of cases exactly like yours: obviously rushed without any evidence to back up. That was a waste of money for you and hopefully this will be a lesson learned. Get ready for a 7-9 month wait for a denial and file again.
