When he returned to the U.S. in August, he received an expedited order of removal at the border and was sent back to Mexico. A few months later, he re-entered the U.S. without inspection. Because of this, ICE has reinstated his prior order of expedited removal. "

 

Linked case #2 above:  " Immigration authorities previous issued an order of exclusion to Morales when he attempted to enter the U.S. in 1997. Morales then reentered the U.S. in 1998, and has remained here since that time. According to ICE, Morales had committed a felony under federal law that carries a sentence of 20 years in prison because he reentered the U.S. after being removed. "

 

Linked case #3 above: " His client, a Brazilian national who had been ordered deported before she married a U.S. citizen, understood the risks as well, but ultimately decided that she wanted to keep the appointment and begin the green card process.

 

All these people had defied deportation orders...these were not AOS interviews after lawful inspection.

I will  say that you are correct in that this is not a good time to be in the US illegally.  Anyone who is currently in an "overstay status" is subject to being picked up by ICE and deported.

If you don't want to take a loan, selling stuff to get up to the amount you need is also an option. Kind of depends on how much you need and your ability to pay off the loan later. Just a suggestion. I hope everything works out and I agree with the others, don't delay AOS! Good luck!

I feel it's NEVER a good time to be in the country illegally, and working without a SSN when they aren't suppose to be working is the problem that has fueled this debate for a long time. File the AOS and please try to follow the immigration rules.

 

My immediate response to your post is that your asking for sympathy, which I don't feel any because you are now afraid of something you've known about ever since she got into her overstay and has been working illegally. Now that the fire is close to you your crying for help.

I'd also suggest to file I-765 which will give her employment authorization and she will have some sort of status again. It doesn't cost anything if you file it together with your I-130 and I-485. Throw in the I-131 (also free) too just in case.

If the OP can not afford to file I-485, how she could provide affidavit of support that needs be submitted together? She may need a co-sponsor.

It's because we moved and spent what we had on that, but I'm getting a loan tomorrow and we're filling the application out now.

Take a deep breath. Relax. The thought of having your family broken up is obviously scary, but follow the advice you receive here and everything will be ok. Fill out your application as soon as you can (tomorrow is a good plan) so that your wife will have legal immigration status again and your ex-landlord's (probably empty) threats won't mean anything. And remember, she should NOT leave the country for any reason until she has received her green card (or at least AP approval), otherwise she will trigger the overstay ban and won't be able to return for a very long time.

No. Since she entered on a Tourist visa (instead of crossing the border illegally, without inspection), the overstay will be forgiven as long as she does not leave the country until approved.
