I want to leave with my son

My husband (the american citizen) has an addiction and he chose that over his family. We have a 4 month old son and I want to leave back to my home country as soon as possible. I'm still in the removal of conditions process that I'm going to abandon. I need to know what are the steps of leaving. My passport is expired so Im renewing it, and my (still) husband is going to sign when we make our son's passport. Do I need anything else to leave, like a signature at the airport or anything?

Yes, he's allowing me to get the baby and leave the country and have full custody of him in case of separation. He said he doesn't want to have anything to do with the baby and he doesn't want the baby to know who his father is

By sign do you mean he will give you a notorized letter allowing you to take the child ?

I can't answer your question with certainty, so my guess is to make sure everything you get from him is notarized. Better would probably to have custody already by the time you leave.

I'm so sorry your husband is not wanting anything to do with your baby, that's really sad. I'm wishing you all the best for you and the little one and a great new beginning back home!

Truly sorry, DeeDee.

It's worth an initial consultation with a lawyer (free or cheap) to find out precisely what you need.

You don't want any surprises at any point of this pending process.

Avoid making any travel plans until all legal items are completely final.

This. A lawyer would know best, but I suspect it would be something similar to what I did when I moved abroad, sole custody with no visitation rights and a notarized letter. You do not want to get charged with interfering with parental rights or kidnaping, so best to do it right.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Sorry for your situation. Make sure that all the documents are notarized (you don't want to be penalized later on for taking the child to foreign country by your husband). If possible, get all the relevant documents from court.

File for sole custody of your child, and in the child custody petition you should establish the terms such as child support and visitation. If you can't afford to pay an attorney then ask the Court a list of pro bono attorneys in your County.

The Hague Convention is enforced between the United States and Romania.Do not leave the U.S without having your child custody .

Despite he doesn't want anything to do with the child your child has the right to receive child support. Failing to pay child support will lead him not to be able to renew his passport plus he can get arrested in case you want to pursue legal action against him if he stops paying child support.

Addiction can be worst than deainmg with a mistress,

Right now that drugs is telling him he wants no responsibilities

so make sure , you at least consult an atty & have proper papers to

remove the child from the US, the child support should be requested

(if you leave) have his SS number some countries foreign affairs

have a dept. that can deal with that.

Do it right he may sober up & make claims to be a part of the childs life,

a child deserve to know their dad, never bad-mouth him to the kid.

You should think long and hard if you dont want to get the GC go spend

a year in your country & see if its the best choice for you and the kid, try to

leave this option open

Thank you everyone. I have no reason to stay in the US because I moved here to be with my husband. Nothing ties me to this place, no friends or family. I was already looking into talking to a lawyer but I couldn't pay one. Im a stay at home mom. The baby doesnt have Romanian citizenship yet, but we're working on it before anything else. His dad said he wants to be removed from the baby's romanian birth certificate. If I leave I dont want child support or anything, I can take care of him myself
