Pregnant and trying to bring my parents! Help !!!

Hi, My parents have been visiting me in the US for years as tourists, but now I am pregnant and would like to request the GC for them so they can be part of the baby's life and help with childcare.

They have a valid 10 years tourist visas.

I need some help because I get two different information all the time some places say I can have them come in on the Tourist visa and apply for i-130 and the adjustment status or I necessarily need to go through the consular process.

Can my parents just come and visit with the baby if the latest is our only option ?

They can visit whilst the Immigrant Visa is in process, takes about a year.

You have to be a USC to petition parents.

Coming on a tourist visa with the intent to adjust status is visa fraud.

They can visit you and the baby, but help with the childcare can be look at as they are working on a tourist visa.

Coming into the US on a tourist visa with the intention to migrate is fraud and illegal. So I don't suggest going down that route.

You can petition for both your parents (assuming you are already a US citizen), and they can be here in the US in a year. While the petition is on-going, they are more than welcome to visit you using their tourist visas; but I stress that if and when they are asked about their immigration plans, they need to be honest about having a petition in the process, and they cannot stay longer than 6 months. If they stay longer than 6 months, they risk the chance of having their petitions denied.

A follow up question is I will be requesting for both my parents.

I know I need to enter one i-130 for each, will the processing time be too different.

Also for the interview do I need to be present ??? I read some where that it was advisable . But with a baby and possibly two different dates that would be very hard .

They will processed as two different cases, but once they are both approved and are at the NVC stage, they are usually "tied" and processed together. And no, you do not need to be present for the interview

Seriously??? Sigh, sorry guys, sometimes I just don't get our laws/visa regulations. Why don't they just make a "grandparent" visa already.

We have child care through work so its really just a cultural things my parents want to be a part of the babies life. I am an only child and this will be their first grandchild. They are just excited ... we all are .

But maybe childcare is something that should not be mentioned

Totally and completely seriously, if a grandparent is on a visit visa watching a child who would otherwise require daycare, that is seen as taking away work, even if the grandparent is not compensated

They do have a grandparent visa provided you are a USC- petitioning your parents luckily the process is relatively quick

Going off on a slight tangent here, but I think the US has some of the most user-friendly immigration policies. Being able to bring parents and siblings is very generous. OK the wait for siblings is very long but in the UK it's not possible at all. Likewise for parents. I saw a thread the other day where the wife had recently acquired citizenship (and the fact that spouses can get that in 3 years is again very generous, compared to other places) and was petitioning for 2 parents who were then going to petition for 3 other children. The whole process would take several years but that's an additional 5 people getting green cards based one person's marriage to a USC. That would never happen here. My brother brought his wife over from Mexico to the UK and she was shocked when I told her that I would theoretically be able to petition for my parents, my 4 siblings, their husbands and between them 9 children (time permitting) all because I am married to a USC. That's an additional 19 people that my husband didn't bargain for when he married me

I just would feel bad if some old folks got in trouble for taking care of their grand kids, seems a little bit too much. There are cultural differences between nations when it comes to grandparents, I think Russians would be aghast at the idea of grandparents being seen as "working" when it came to babysitting their grand kids!

Yeah I agree with you on this one... after all, if we followed the logic, a pregnant woman who came on a k-1 and has to wait for AOS to work should have to hire a full time nanny and never lift a finger to care for her baby till she gets work authorization, as it could be argued she is doing work that otherwise someone else would have to be hired to do. And why doesn't the same apply to housework, cooking, and other "chores"?
