    My interview- 28 jan 2020 (consular said visa approved) sydney consulate(indian national)
     
    Receive ds 5535 - after 3 hours of interview
     
    Submitted ds 5535 - 29 jan(received confirmation as well ...automated + personal)
     
    Case date updates(I never sent any email to consulate to ask the status of my case.)
     - 15 feb, 18feb, 21feb, 24feb, 5 march, 12 march
     
    As u all know, our case statuses changed to refused on 3rd/4rth march...on 13 march friday(refused status changed to AP status again). At this point, I guessed that my AP was over.
     
    25 march wednesday- Got visa issued
     
    Good luck to everybody. I wish this corona thing will go away ASAP and u will all get ur visas soon. 😊 Thanks everybody.

    I think it is. We were very nervous when we were waiting. 5 weeks total, but ended up issued. If they kept the passport already a good sing. Be patience, it will take some time. I am sure it will be fine

    Yeah, I had an issue with CEAC that day. I think they had broken it or were doing maintenance. It should be working now though.

    You will need a police certificate uploaded from all foreign countries that you lived long enough at uploaded to the NVC and you bring the original(s) to the interview.   You are not needed to get one for the US for a US interview.  USCIS will pull a FBI (and other reports) when it processes the I-130 and the NVC will verify that you haven't traveled again to the US before they send it to AIT.

    If you ... AND you... THEN submit a police certificate from... Are 16 years old or older Lived in your country of nationality for more than 6 months at any time in your life Your country of nationality Are 16 years old or older Have lived in your country of current residence (if different from nationality) for more than 6 months Your country of current residence Have ever lived in another country for 12 months or more Were 16 years or older at the time you lived there The country where you used to live. Were arrested for any reason, regardless of how long you lived in that city or country, and no matter what age you were   The city and/or country where you were arrested. Note: Present and former residents of the United States do NOT need to submit any U.S. police certificates.
    Important: Police certificates expire after one year, unless the certificate was issued from your country of previous residence and you have not returned there since the police certificate was issued. If at the time of your interview the following three items are all true, you must bring a new police certificate to your visa interview:
    You are more than 16 years old; The police certificate submitted to NVC was obtained more than one year ago; and You still live in the country that issued the certificate.

    My I-130 was approved today on August 19, 2020.
    I did not receive any E-MAIL notification. My case was moved only once on August 7th.
    (Good luck everyone, and will receive good news as soon as possible!)
    Is the next step to wait for NVC's notification?

    I'm also working on submitting the I-864. My joint sponsor is submitting all the documents you have listed above.
     
    My joint sponsor is married and files taxes jointly with their spouse, so I am having the spouse fill out an I-864A and submit their w-2. Some embassy officers will ask to see proof that the spouse knows of the financial commitment.(This isn't always the case, but I have seen many others recommend having the document.)
     
    Tax return/Tax transcripts: You only need to provide one or the other. There is no need for both. 
     
    Uploading documents: The documents should be uploaded in separate files. When you add documents to CEAC, there is a menu to indicate the type of document (w-2, passport, tax return, etc.).

    Glad your interview went well this morning! Seems like the interview was just basic checking docs and simple questions about the petitioner and beneficiary.

    I didn't say a thing about paying taxes.  I said file the federal tax return.  State tax returns are irrelevant to the I-864.  Words mean thing.  No need for "other words".  I meant exactly what I said.

    I believe you are doing a poor job of relaying your lawyer's advice.  It's about terminology, so I'll correct both yours and the OP's with this explanation.
     
    The I-130 is a petition for alien relative.  In this case, petition for spouse.  It is not an application for anything, and the US Citizen "applies for" nothing.  When the petition is approved, the door is open for the foreign spouse to apply for a visa.
     
    Your lawyer may have advised you to be back in the USA at least six months before the visa is issued, but makes no sense to say before the petition is approved.  It's possible for the petition to be approved in six months or less.
     
    The OP already has the correct advice, which is to be able to show evidence of intent to establish actual domicile in the USA before the visa is issued, preferably at the time the affidavit of support is submitted to NVC.  The couple is seeking a US immigration benefit intended to enable them to live together in the USA.  He'll need to be living in the USA when she arrives or to arrive with her, and live with her in the USA, in order for the current process to be successful.
     
    Nothing stops him from going to Canada to work before or after her immigration, but SHE, must maintain permanent resident STATUS in the USA, or lose her green card.

    You are the petitioner.  Your divorce decree "original certified copy" is NOT NEEDED at the interview or NVC stage.  Anything from a tax return is a "copy" by definition.  Scan, email and print locally, is the same thing as a photocopy.  Photocopy is just scan and print in one pass without the email part.  Photocopiers scan and print.  Any form of scan and print yields the same result.
     
    So, yes, you are either wrong, or simply unaware of some basic facts.  Same result.
     
    People who are not capable or do not have the aptitude to read carefully, interpret literally and act accurately, are better off with professional guidance than to try to do it themselves then whine about their mistakes later.  Drop the attitude and you'll get better help here to solve the problems YOU caused.

    Sounds like you need to read the instructions more carefully.  The foreign spouse's Birth Certificate is not required at the petition stage, but current marriage certificate is.  US Citizen spouse must provide evidence of US Citizenship.  A US birth certificate is ONE option for documenting that.  NVC is not asking for US Citizen Birth Certificate, but they do ask for the foreign spouse's Birth Certificate, which was NOT required at the petition stage.  Read instructions, all instructions, CAREFULLY, then apply some common sense.
     
    You'll get better help here if you stop whining and start "appreciating" the help you are being given.

    For a spouse or child it is 3 times the amount in in I-864p for assets.      125% of the I-864p amount less the projected annual earnings times 3.   Lets say 125% of I-864p is $30,000 and she earns $25,000.      30,000-25,000=5,000 times 3 equals $15,000 in liquid assets.

    It depends on the household size of the sponsor. I am sponsoring my husband and we have two children, so my household size is 4 and that means a minimum income of $32,750, I think.  
     
    Here's the government poverty guideline calculator for I-864 you can use. 
     
    When it comes to having liquid assets, it's a bit more complicated I think as you have to do something like divide the asset value by 4 or something.

    I’m sorry to hear - that must be frustrating! I have a question about the foreign income - did NVC confirm that it can be used? To my knowledge only US based income can be used for sponsorship since they wouldn’t make a contract with someone that doesn’t have the financial means in the US. Curious to hear more about how that can be accepted in your case!

    Provide evidence of time spent together in person such as passport stamps boarding passes etc.  Photos together over time.  Skip the affidavit from a friend.  Makes you look desperate.  Lots of discussion about this in this forum.  Do some reading.
