    I wasn’t second guessing anything, I was asking a question. That’s what a “?” generally indicates.
     
    I’m on my phone so posting direct quotes is a little different, but there were multiple posts by different users along the lines of “your wife can still use her visa to come to the US” and “your wife has completed the required steps to obtain a visa, she has a valid visa”. Change “your wife” to “you” in those comments and post them here, automatic TOS violation? I’m honestly interested to know.
     
    As for Brian 2’s obligations Re: I-864, that sounds like his issue, not OP’s. Probably should have thought that through before cheating on his wife.

    No one seemed to raise any ToS issues when Brian was told his wife could still come to the US. Not sure why it’s different in this case?

    I think she needs to vacate or reverse the "annulment due to fraudulent marriage" ruling from divorce court first. I don't think it'll go very far in immigration court where the other side is just gonna scream "Your honor, there is already a ruling of fraudulent marriage on this defendant".

    They just moved to the US yesterday.  It's a foreign employer; not a US employer.  So there is no skirting of federal obligation since it's not a US company.

    No one is here to be rude - we are helpful, but you also gotta take some responsibility and educate/familiarize yourself  with the process, and then ask specific questions once you have a general idea.
     
    Claiming to be a “helpless” woman is nonsense.  You have the tools here to empower yourself.

    perhaps if you actually took time to take his advise, read the requirements and help yourself like the rest of us ladies do you wouldn’t be quite so helpless.. after all, you seemed perfectly capable when it came to creating the situation, now you need to work at resolving it too.

    Hmm well to be fair we normally are used to seeing strong women.
     
    The issue that may arise is that you will basically need to get divorced and immediately marry and file to stay in status, so that may rise eyebrows when seeking to adjust.
     
    You could file a change of status to a B to give you a bit of breathing room.

    I've been helping you.  Instead of being rude to someone helping you, maybe you should actually read the Guides so you can help yourself.  
     
    This is a do-it-yourself forum.
     
    Pointing you to the Guides so you can read and understand the AOS process is better than you asking random questions about different parts of the AOS process.
     
    Don't play the "helpless woman" part.  That's demeaning to women.  Read the Guides and empower yourself.

    I think that’s a little unfair. Major surgery is traumatic, and family can give the emotional support a nurse can’t. Said as someone who has both undergone it and been with family members who have. Sometimes you just want someone to sit and hold your hand.

    Talk to an accountant and as above check local requirements/restrictions but the simplest advice from the US perspective is: if you plan to sell anything, sell it before you enter the US. After you enter the US and become a green card holder, you will be liable for capital gains tax on any gains. If you sell it before you become a LPR, it’s not taxable in the US. You won’t get taxed on the value of assets so just moving funds from Cambodia to the US won’t attract tax. You will however probably be asked to describe the source of funds for anti-money laundering measures. 
     
    You will have to declare worldwide income on US tax returns. Usually, double tax agreements and the foreign income exemption mean you won’t have to pay much or any tax in the US if you are tased at home. When you get to the US, I think it’s worth paying a tax consultant familiar with overseas income to help navigate the best routes.
     
    if you have cash or stock accounts worth more than $10k in Cambodia after you move, you will be required to file an annual form called FBAR with the irs, due same time as tax return. It’s a simple form, just detailing what you own offshore.

    There is no requirement to file AOS before the I-94 expires.  You must marry or leave the US.  To continue to have legal status you file AOS.   You can get married anywhere in the US.  If being out of status is something you want to avoid, go get a civil ceremony someplace where you can get the certificate ASAP before your Big Time LA wedding.
     
    You could have skipped all this nonsense by doing a spousal visa.

    OP is unhappy with the lack of direction he got from USCIS but his real gripe should be with the time it takes to get his marriage certificate in LA.  In many locations it can be had the same day.  When we got married I hand carried the signed license to the county court house and got my official certificate same day.

    That is written correctly. I see no lack of grammar.  In addition, EVERY non-immigrant who enters the US is out of status upon expiration of his/her I-94.....even K-1 non-immigrants...

    Even if she secures a visa that allows her to work, does she already have a US bar admission? Only a few (like Mass) have Foreign Lawyer Registration and even that limits scope of practice. Otherwise she’d need to sit for a bar — it’s common for international lawyers to do an LLM in the US then sit for NY. Or find a role where she is not practicing.

    The situation is this:
     
    You are going to be questioned by someone who probably gets, at best, 3 weeks holiday a year. Not only that but his job is to automatically assume that everyone trying to enter as a visitor is intending to stay illegally. In this situation it’s guilty until you can satisfy them that you are innocent, not the other way round. He doesn’t have to look for any reason for your situation to be a genuine visit, you have to prove it to him. 
     
    So, with that in mind we have someone who lives at home with mum and dad, with no bills or financial commitments in the UK, buying a ticket  at the last-minute for a holiday longer than the CBP Officer has over several years combined, who claims to run a company (that can run itself for 2 months?), with a love interest in the US (have you actually met before?), with £4K to his name (is that before or after the ticket purchase?) and now ask yourself what you can show the CBP Officer that you have every reason to return to mum and dad’s spare room?

    You *could* provide a letter from HR confirming that you will have health insurance benefits with spousal coverage as part of your job, but I doubt that it would be necessary. The health insurance system in the US is primarily employment-based, so it is the norm for any full-time job to offer health insurance benefits, which are extended to the employee's spouse and/or children (though adding these raise the amounts you have to contribute to the monthly premiums). If you do ask HR for such a letter DO NOT tell them that your husband is HIV+ (and according to HIPAA, they are not allowed to ask about such things), just tell them that you want confirmation of health insurance coverage as part of your employment benefits.

    You (should) only have to show the job salary and benefits, including medical, to overcome the public charge issue.
