    People,

Let's keep this topic civil and productive. We know emotions and run high during these types of discussions. Please do not derail the thread.

    Mod hat off...

I have mentioned this before in another thread a week ago of the same topic about making the K1 mission critical. The reason why the K1 gets put on hold for the time being is for one, as @Lucky Cat mentioned, by law a fiance is NOT an immediate relative. And for two, anything can happen before the beneficiary gets married and AOS to make them a permanent resident. Meaning a K1 recipient could end up not getting married at all. Or the get married but abandon their status and return home. Or the AOS is denied for the K1 reciepient. So the risk of issuing the K1 is that much higher than those of other family based visas. This is simply an explaination on how the government views things. It is so people can have a better understanding of some decision making processes. It also helps people come up with solutions that can be bargain with. For example, if you understand that K1 applicants are high risk, maybe a person can petition that the K1 category be processed at limited capacity ( for those who were near the end of the process) until things are back to normal/

But writing and calling political figures to express your concerns and desires for change are a right and people are free to do so. There may be a movement that will put the K1 back on track. All information is helpful and useful.

I’m sorry but what’s the point of posting this? People are pretty desperate right now and contacting your congressman is something we are entitled to do. Will it work? Probably not. But I would think this community more than anyone would understand what so many of us are going through, instead of going “well actually...” and getting caught up in semantics (even if they are relevant)

Most of us doing a k1 would already be married if it wasnt for covid. So you can pretty much think of them as our spouse.

Look if you don't agree with the post fine. But don't sit there and tell us not to do something. So you mean to tell me a professional athlete should be able to get in but not my fiancée? I'm sick and tired of hearing CR-1 IR-1 people saying that our Visas don't matter. Go to another forum if you don't like it.

HispanicLover, absolutely! All I said was good luck, they're going to need it. Investigation into people's background is much deeper now, and I don't even know why they would post such a thing if they don't want to hear the reality of the situation. Thanks!

You do realize that you came on here asking for OUR opinions correct? If you do not want realistic answers you should not be asking the questions. I highlighted the information that YOU provided us. It clearly reads "I married a friend last year to help get her documents" then act as if people are assuming you were committing fraud. You literally and willingly just provided those FACTS to us. We are all here to help each other out and ask questions to assist in a successful journey. If you are not wanting real answers you should probably stop wasting everyone's time.

This feels like we're being trolled folks.

    1) OP admits visa fraud
    2) OP asks for advice
    3) OP ignores all advice, argues with those giving it

Doesn't seem very genuine to me.

If your current relationship is legitimate, then go for it. Just expect a lot of questioning about that previous relationship and to give a solid legitimate reason why the immigration services should give you a visa.

Regarding people's reactions, from what you have said, it sounds like your previous relationship revolved around deceiving the immigration services to bring in someone with the wrong intentions. Whether it was or was not, that is how it is sounding. K-1 Visas are notoriously strict and unfair and an unbelievably hard process to go through that has been made progressively even tougher throughout the years due to those taking advantage of the system to bring in someone to the US for the sole purpose of them getting a green card rather than the purpose of being with someone who you love (AKA Immigration fraud).
The way your case is coming off is immigration fraud, it's a sensitive topic for those who are applying for K-1 visas as a lot of hoops that we're trying to jump through are because of immigration fraud cases.

Do you have to justify your reasons to us? No, after all, we're not the ones who decide whether your petition gets accepted and whether your fiance gets a visa. We're just a few people on this world going through the same process you want to go through.
Do you have to justify your reasons to the immigration services, who are directed to make everyone nervous (including those with completely clean records)? Yes. This is a question you are going to have to answer a number of times, and if you're getting defensive with us when we're mostly asking base-level questions, then you're going to have to work on your explanation by the time you get to the questions from immigration services.

Most importantly, do not lie (especially to the immigration officer/immigration services). Sure, hiding true reasons for your past relationship may seem like a good idea, but they will find out whether you like it or not.

The marriage was legit... but you were never serious. That does not sound "legit".

Most people do not marry "friends" to "help them get documents" - getting married to circumvent immigration law is not exactly legit.

You admit to committing fraud in a previous relationship and you want to know if it will be a problem?

Since all of this has happened in a close timeframe, yes, your previous relationship is going to come up. Any previous relationships where immigration was involved must be shared and since this was just last year that you were in a marriage, you are going to get some tough questions.

For example, how do we, and more importantly the interviewing office, know that you are not committing the same act with your fiance? You have already set yourself and your fiance back by your history. So now you have to deal with the issues that may come with it.

The condition is for us to be free to marry and I have enough evidence to support the legitimacy of my relationship so how is that going to be a problem? Marriages end all the time, doesnt matter whether it ends in 10 years or 1 year. I married someone I wasn't in love with and I divorced the person to marry the one i am in love with. So why should that be a problem?

The problem is you helped someone commit immigration fraud. I don’t see how you don’t see that’s the problem. How do you prove that isn’t the case with this one?

You definitely should get more involved in the process even if you keep the lawyer. Nobody will ever be as interested in your case than you. Don't solely rely on them. Good luck 😊

Why have you retained that lawyer?  You're paying them big bucks, and they're not even available for questions?  I would dump them and continue this process yourself, with the help of VJ.  Unless you need a waiver or have a criminal background, there really is no need for a lawyer for a K-1.

I'm not really sure where to add this bit of information but it was very helpful for me regarding insurance for immigrants in the US. I have been searching the web, asking multiple forums and making several calls trying to figure out if my fiancé would be able to use the Marketplace to shop for insurance on a K1 visa. This article from healthinsurance.org answered all of my questions and some. Hopefully this information will be of use to others with the same questions.

I would renew the passport now while you aren’t going to be using it. However the passport office says—-
It is taking longer than usual to process applications because of coronavirus (COVID-19). Do not apply unless you’re travelling before September 2020 or you need a passport urgently for compassionate reasons.

The rest of your questions are just too much overthinking, mate. Let things roll because it is all uncertain now. Solve those problems if and when they actually become a reality. Or add to your list —

    5. If my brain explodes because I thought up so many unlikely hypothetical situations, will I still pass my medical exam?
