    That's exactly it...too many LPRs do not understand their full rights in a situation like that.
     
    A "request" by CBP or ICE can be deemed as an "order" followed under duress by someone who feels intimidated, or when the "request" is worded in such a manner/tone that the person believes they have no choice but to comply.

    The point is this should not happen, or better yet, it only happens to those that do not know their rights.  CBP can certainly ask an LPR to give them the GC, and I suppose many folks may be intimidated enough to give it up, but only an Immigration Judge (IJ) can actually take away LPR status after a proper hearing.  So if your husband is stopped by CBP at a POE or some other checkpoint and asked to give up his GC or sign a form giving up his LPR status, tell him to not give it up or do it and demand an IJ hearing.  It is not exactly the same thing as the OP's wife giving ICE her passport, but it is similar as ICE does not have to the power to confiscate a foreign passport, they can ask for it and possibly coerce someone into giving it to them voluntarily though.

    The instances I've heard/read about were when an LPR is returning to the US and has had frequent stays abroad (and doing only "touchdown visits" to the US) and the CBP officer determines that the LPR is misusing their greencard, and requests the person turn their GC over to them right then and there.  Only an immigration judge can determine whether LPR status should be revoked (after due process, and a hearing in court with you present to plead your case).  The CBP officer can refer to the proper department that you appear in immigration court, resulting in the person getting a Notice To Appear in immigration court, but they are not the deciding person about whether your status is revoked or not.

    Do they have the authority to confiscate the green card?  Yes. 
    Do they have the authority to take away your status?  No.
     
    The LPR would either leave voluntarily, be paroled into the US pending a hearing with an immigration judge for a hearing, or detained until a hearing in front of an immigration judge.
     
    If CBP demands that you sign the i-407 form at port of entry, you should refuse to and request differed inspection or a hearing instead.

    You can only apply for asylum within the US or at the border to the US. There is no way to apply abroad. I believe there is a 1 year or under time period upon entry too...?
     
    Nobody “finds a reason” for asylum (with a legitimate claim). They are currently and actively fearing persecution.

    I question the use of the term "voluntary" regarding her handing over her passport, since any action that came about as a result of fear/threats I would considered that coercion. Bills are being pushed to make sure the law recognizes this clearly as well. It's already been used as an argument for coercion in a number of human trafficking trials I've personally worked on.
     
    I don't know what sort of demeanor these officers had, but it's reasonable to assume that anytime ICE shows up at your door it's going to be intimidating, especially in the current climate. I know I would be nervous, even as a USC who works for the government and knows immigration law pretty extensively from multiple sides.
     
    I would suggest getting in contact with an embassy as well as possibly reaching out to one of the many organization the Dallas area that work on immigrant legal issues. At the very least, I am sure those organizations will want to know about this experience. If you were in Houston I would be able to give you some specific names, but I'm a little less familiar with Dallas. I personally don't find their hypothetical willingness to return the passport as that important in terms of reaching out for help when they took it under questionable circumstances to begin with. 
     
    My husband and I filed our AOS late due to our joint sponsor losing his job when the company he worked at for 16 years closed unexpectedly. I would be livid if the result of that had turned into this level of harassment.

    Well, believe me or not, we are too, dismayed with the way things are politically and economically in the US and what that may entail in the long run if that continues. It may come as a suprise, but you may find President Trump is not that much different from President Duterte...

    Everyone should know their rights regarding ICE. Unfortunately, your wife gave her passport to ICE. She needn't too. But then again, I wasn't there and I might have done the same. I hope your lawyer can get her passport back especially since she wasn't formally arrested and detained.

    Wow. Just wow. Would you like to hear what my ex-husband would say about what he did to me while we were married? He'd say he was protecting me, cherishing me, helping me, that he loved me and I was the most important person in his life. In reality what he was doing to me was very similar to the OP -- he completely controlled and abused me financially, emotionally and sexually. Like the OP, I was with him for five years before we were married, but he came over on a K1. He didn't escalate his abuse as quickly as her husband did. It was a long, slow burn that I did not want to recognize until he had broken me completely. Before our wedding, I had many people telling me that our marriage would be a disaster and to pay attention to the red flags that were flying but I was in love and wouldn't listen to any of it. If anything, it made me closer to him. 
     
    Of course I was the American so I didn't have to worry about whether or not I could leave when I finally realized how bad things had gotten -- and even then, I didn't leave him because I was brainwashed into thinking it was all normal. It was normal to be lavished with gifts and attention one moment, and then have them withheld when I did something "wrong" (which was always a shifting point). It was normal for him to insist on trying for a baby even when I told him I wasn't ready. It was normal to have him tell me how stupid and useless I was for every single minor transgression of everyday life. Did I "document" this? No, I didn't even realize what was happening until I was a shell of myself. I was too embarrassed to tell my friends and family what was happening to me, and as time went on I stopped thinking that my life could be any other way. To other people my life looked perfect -- beautiful home, a seemingly loving husband, all the creature comforts. I thought nobody would believe me. Even now that we're divorced, he's still trying to insert himself into my life by attempting to break my fiance and me up. It's a nightmare that doesn't end, and some of our friends still can't and won't believe what happened because he's such a charming guy. 
     
    So yeah, I believe this woman. She was with him for five years before she married him, and the distance may have made the faults less obvious. She confided in a friend when things got bad, she went to be safe with her family (wouldn't you?). She reported what happened to a women's shelter and they gave her some good advice. (There's your "documentation"!)  She went to a therapist and was diagnosed with depression and PTSD from the abuse. (More "documentation"!) You see only timing, I see a woman who got out. If she has a way to adjust status, and I don't know if she does, I'm not going to be so presumptuous to say she does, she should pursue it. What does it cost you to believe this person?

    I'm sorry if I seen to be without a clue here. With everything that is going on lately with this Visa process, its a wonder I can find my way home from work 😅. Believe me when I say, I Don't regret any of it, Not for 1 second! I absolutely cherish the ability to participate in this process and thank God every day for my Angel that he has Blessed me with. And I thank everyone here for sharing their knowledge so freely.

    Don't know what the B exemption means, but I do know that it does not mean booster. I believe A means not age appropriate.
     
    DT is one of several vaccines available for Diphtheria/tetanus. According to CDC, DT, DTaP and DTP are not age appropriate after age 6, so you don't need those. For ages 7+, the appropriate vaccine is Tdap, followed by a Td booster every 10 years. Tdap adds protection from pertussis.
     
    Since you were vaccinated as a child against Diphtheria/Tetanus/pertussis with either DTP or DTaP, you may have only required the Td booster, which it looks like you got last year. Have a doctor confirm this. That leads me to believe that the vaccine that you still need to get is the influenza, although currently it is not flu season.

    Yes. I couldn't fit some of my employer's names or addresses. I printed out the form and hand wrote the addresses. On the forms my attorney completed, she also printed the forms and used a typewriter. You can also print and scan the forms, and then fill them out with Adobe Acrobat or similar, and change the size of the font so that more characters fit.

    Then can you fix your timeline? Timeline has totally different dates and information and makes it difficult for people to give you accurate advice.

    From what I understand, you may use medicaid for yourself. Its not like cash assistance or housing assistance, from which your husband could derive a benefit. Medicaid applies just to you. Someone please correct me if I am wrong.
     
    IMO, I don't see the risk in being uninsured if you qualify for medicaid.  You can apply for it when/if you need it, instead of applying now, unless you are talking about wanting to get preventative care, etc. If you find yourself in an emergency, you can apply for emergency medicaid. You may find a job that offers you insurance before you would actually even need use medicaid.

    We made our own passport photos, but read the guidelines and tips. I used an app called PassportBooth to take the photos, and printed them at Walgreens for less than $1 for all 12. I borrowed a projection screen from my office and set it up on my patio on a cloudy day to prevent shadows. My spouse and I took turns taking each others photos. It worked perfectly. All that being said, if you are unable to go through that trouble, then your best bet is having them professionally done. Walgreens is expensive at $15 for two photos. Costo and Sams are only $5 for two photos, if you've got a membership.
     
    I'm curious what they use all of those photos for, since the GC came with the photo taken during biometrics.
