  1. You do not need to wait for the transcripts. Upload a copy of the tax returns and upload a statement saying you do not have W2s because the income is not from the US. If you search on the forums you can find a template for no W2s/1099s.
  2. Short answer. With evidence you were in the UK for 4 months (entry/exit the UK, boarding tickets, a couple of photos together). Your relationship is strong enough for both the K1 and CR1. Simply speaking. All you need as evidence when filing a K1 visa is proof you met at least once in the last two years. For the CR1/IR1, I have seen people from low fraud countries only include the marriage certificate. And receive approval. No marital evidence. Others from low fraud countries will get married during the first visit. Their marital evidence ends up being the same evidence one would include if filing the K1. Get married online with Utah. Another UK/US couple has gone that route as getting married in the UK requires a special visa. Your relationship really isn't all the abnormal. And quite a few international couples get married after 1 or 2 meetings and a few weeks together.
  3. You would have to read through the old January/December/November/October NVC Submission posts. I'm fairly sure I've seen several people with first or second RFEs submitting additional documents. And then being DQ'ed on time. Maybe read March 2021/April 2021 NVC submission threads to see if anyone was given an RFE for 2020 taxes on their second review... then decide how what you want to do...
  4. I would reach out to the consulate and ask them how to proceed. Seems like you can keep the passport in your maiden name as long as you provide the declaration you want to keep your maiden name. Ask them if it is a form you need to complete or just a signed statement.

Therefore, a name declaration might be necessary before a German passport can be issued in the new name.

  8. Does your mother want to return to the US for a visit, because she wants to live there or because you think she needs to be in the US when she files petitions for your siblings? Or because she wants to renew her green card before returning home?
  9. I also think there is more to the story. It isn't just a cultural difference. On one of my flights back to Korea, I met a woman whose husband was a Korean adoptee. He was sent to an orphanage and eventually the US by his stepmom (while the dad was away for work).

  11. If you look at previous months you'll see the majority of people are moved. Last year, a lot of us online filers were first assigned to Nebraska only to discover 3-4 months down the line we are moved to another SC. My advice is to ignore the initial location on your NOA1. Check with ask Emma either 1.) after 4 months (so in September 2022) or 2.)after you go into Active Review. Some say Active Review is an indication your case has been transferred to another SC or assigned to an officer.
  12. That is not true~ But, there are some issues with online filing. Especially if there are multiple marriages (form will sometimes say the current marriage has ended). Also, the part of the application about prior entries to the US is different. Paper filing is clear you only have to disclose visa/type of entry if currently in the US. But, online version sometimes forces you to disclose your last entry. Some worry that might compromise their case as USCIS might believe the beneficiary is still in the US.

  14. IF this is at NVC stage. The daughter's case will probably go back to the end of the queue and you need to wait another 75-80 days from submission of the requested document. You can do several things: I think you can request an expedite and ask if the daughter's case can be linked to the mother's case. OR you can request to reschedule the mother's interview while you wait for the daughter's case to be DQ'ed. ETA what date in March did they submit the documents?
  15. NVC can be so tricky! Hopefully you get DQ'ed next month... right now NVC is taking 76 days so you should get your answer around June 21/22. Go to the UK in September. Around November/December request a transfer. I believe transfer can take a couple of months. Maybe that gets you to Feb/March then you interview sometime in April or May... you have 6 months to leave the UK after the medical. If the request is denied, you go back to Nigeria to wait for your interview date. And take along your UK PCC... ETA maybe have a read in the UK forum to see if anyone has reported a transfer request so you can understand the timeline.
  16. Correct me if I'm wrong but the OP could have filed the I-130 when they filed the waiver, correct? They did not need an approved waiver before filing the I-130 and the I-485?
  17. You can probably cut your photos down to about 20. No need to have multiple photos showing the same event. No need to have multiple photos showing the same type of activity. Keep it to: photos of the two of you in places that are famous/easily identifiable; a few photos at your wedding (with guests/family) and one or two photos from special events Christmas/NYE.
  18. Which country are you from? I believe the waiver is only needed at the interview. It is definitely not needed when you file the I-130. Some people file the I-130 as soon as the beneficiary leaves and then leave the case at NVC so they pass the 2 year mark at the embassy interview. You can request a transfer after you have been DQ'ed If your case is at a U.S. embassy or consulate, contact the potential gaining U.S. embassy or consulate in writing to request a transfer of your case. Please include a justification for the request. If you are not a resident of that country, specify that in your request Just email London and request the transfer. Submit evidence you are a resident of the UK. Maybe submit the transfer request 6 months after you arrive... London interviews appear to be happening very quickly. You will have to leave for the UK before your visa expires (6 months after medical). So, you do not want the interview scheduled 8 months or so before you are ready to leave the UK.
  20. Your income for K1 should be fine. The I-134 is not binding. You'll have to file the I-864 when your partner arrives and that's when income will be more important and/or you will also be able to submit a joint sponsor. I would continue with the K1 if that's what you feel comfortable doing. But, double check with your partner if she is okay with potentially not working or driving for maybe 12 months (EADs are speeding up according to some- but plan for the worst hope for the best). Check the requirements for obtaining a drivers in the state you plan to live in. Many people think they are okay with being completely dependent on their partner but if you are a truck driver and not at home for a few days to a week or more at a time... your partner might find the adjustment very difficult.
  21. Have you submitted documents to NVC and are you waiting for DQ? Nigeria has a backlog. So, if you wanted to keep your appointment there you could probably study in the UK before moving to the US. May 10- someone was still waiting for IR1 interview and they were DQ'ed January 2021. But, the UK has no backlog. So, if you have already submitted all your documents to NVC and you transfer the case to the UK. You might be able to move to the US in the next 4-5 months. I am not sure of your situation. If you have not submitted any of your documents to NVC you could delay your case for a year or so.... You can refer to this post:
  22. I suggest you also reach out to a law firm in Malaysia to see if they can help you understand the situation. Try to get information from the former boss (discover the name of the Malay lawyer who defended your father-in-law; obtain the paperwork from the proceedings). Good luck! Sounds like your father-in-law was lucky to escape a very dangerous lifestyle. Hopefully, he can join you in the US.
  23. In your previous posts you mentioned sponsoring your parents and your wife. What happened to your father and your wife's petitions? Being unemployed and sponsoring 3 family members might lead to the CO requesting you obtain a joint sponsor. Obtaining a job now (if your mother's case is currently and NVC) might lead to a refusal at the interview as some COs want to see a long work history. 3-4 months of employment might not be sufficient. If you are no longer petitioning your wife and father you might be okay. But, if their petitions are still on file you should be acting as if you have a current household of 5. (This is my conservative approach to your situation).
  24. Currently, EAD is taking 8-12 months (work authorization). But, USCIS has just decoupled the EAD (work authorization) from AP (travel authorization). and some people have reported receiving work authorization sooner. You can read the adjustment status case filing and progress reports for updates. As you are an April 2021 filer you will probably get your NOA2 soon. I wouldn't pursue work sponsorship as it will probably take as long or longer. Not sure what you are doing now but finding an employer in the US seems to be very tricky.
