  1. Your plan to use assets probably isn't going to work. Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner’s claim of its net cash value. You may include the net value of your home as an asset. The net value of the home is the appraised value of the home, minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the home. You may not include the net value of an automobile unless you show that you have more than one automobile, and at least one automobile is not included as an asset. Hold off on applying for your husband until you can secure your own income OR get a joint sponsor.
  2. Personally, if you want to use assets I would only file once the money has been in your bank account for 12 months. You're setting yourself up for an RFE. You could put it in the joint account OR your own account but when you submit your supporting financial documents you won't have had the money in the account for the requisite amount of time so it doesn't matter. An extremely suspicious person might believe your husband's parents are paying you for his green card (because you'll be documenting the money comes from them). So, in your account or his.. the source of the money could be problematic. Do you have anyone able to joint sponsor if you do receive an RFE? It has been suggested before BUT I would submit the forms with a joint sponsor and when you get to the interview stage show you are qualified to support your husband alone.
  3. Assets are tricky. They might send you an RFE after you send the application in. I would document where they money came from and why you suddenly have $150K in your account when you don't work and haven't filed taxes. ETA: From my understanding the review the I-864 before you even get to interview... they'll review it a few months after you send in the application.
  4. They've moved your question to the correct forum "Adjusting from Work/Student and Tourist Visas". Your husband will be able to adjust from student visa. You can read the guides here for all the forms you'll fill out: Unfortunately, you can't wait until the interview to show you have sufficient assets. You'll need to send in the proof when you file the paperwork. Is it possible to obtain a joint sponsor? Do you have any friends or family members who are willing to help you out?

  8. Some consulates (like Montreal) used to require the USC move back to the US before interview stage. (I believe they're more lenient these days due to Covid) And several members have moved back to the US before their partner as it helps prove domicile/helps with I-864. You have strong evidence for the I-130 to be approved (5+ years living together in Europe) and after the move you'll have strong proof for domicile.
  9. You're getting conflicting answers because there are no hard and fast rules. When your wife re-enters the US how she is treated depends on the CBP officer she meets. I have a couple of USC friend's who've been questioned by CBP quite aggressively after re-entering the US after a long absence (but nothing else happens as they're US citizens). If you have no set plans, what's the harm in returning to the US and applying for the I-131? You never know what the future brings.. you could be traveling and decide for whatever reason you want to stay outside the US for over a year. This takes the guess work out of your travels and you won't be (potentially) risking your wife's green card. What's sounds more stressful? Flying back to the US now or dealing with coercion to file I-407/ a notice to appear when you finally decide to return to the US. Your choice.
  10. Re-upload the marriage certificate with the correspondence from Gwon MinJeong (showing their credentials/official email). Then write a note stating you married prior to 2008 and this is the only documentation available. They closed the phone lines a few weeks back. Not sure if they will open them back up again. People would call NVC if they made an error when reviewing documents. Have you managed to move your case to France yet? You can send another message to NVC explaining your issue. Hopefully if you log your complaint not only via the upload but also through the NVC email they'll DQ you after you upload the W2s/1099s and the same marriage certificate.

If you can chat to they and see if they can get official documentation stating this was the marriage record you received in 2007 and there is no alternatives maybe do that (and upload that statement) OR see if you they can go to Gwangju and get an updated record of your marriage... Unfortunately the phone lines for NVC are closed... so you can't chat to a Tier 2 officer to escalate the matter. You might also consider emailing the consulate in Seoul and ask them how to manage the situation... they might have some knowledge on the documentation for two foreigners who married before 2008.

  13. A member from Japan had a joint sponsor (and a friend of mine has a joint sponsor) and they were still asked for various pieces of documentation from the main sponsor.

You might be get DQ'ed without a letter explaining employment/proof of income BUT I'm fairly cautious and included documentation we might not have needed to upload.   15. We uploaded a statement about W2s/1099s because we uploaded the tax return from 2021 not the tax transcript. We also uploaded proof of current employment/income in the form of a work contract. As I've seen RFE's for not including proof of income when the main sponsor's income does not meet the minimum requirements. I've seen people recommend you either upload paystubs or the 재직증명서 (proof of employment). We decided not to upload those documents as my husband's full name is not on either document (just his first name in hangeul).
  16. The certificate you used: Was it in English or Korean? I just saw in another forum someone's Korean marriage documents weren't accepted.... If you do not have the correct document you will have to enlist the services of a third party to go to the place you got married and get another copy for you.
  17. I would re-upload the I-864 to "additional documents" with an explanation. But, it is all about your thinking on waiting until the first review. You either wait for a possible RFE and have to wait another +/- 75 days or you re-set the clock for another 75+/- days now OR you don't reset the clock at all (if we are correct in thinking uploading to additional documents is okay). We uploaded additional docs after first submission and got reviewed at day 73.
  18. I assume they were living in Korea at the time they got married. It is fairly cheap and easy to get married in Korea. The local district office will provide you with a “Certificate of Marriage Registration” (수리증명서, pronounced soo-ree jeung-myung-suh). When both of the marriage partners are U.S. citizens, they will receive this certificate form right away. However, if one spouse is a Korean citizen, this process can take up to 3-5 days, and will be reflected on the Korean marriage certificate (혼인관계증명서, pronounced hone-in-gwan-gae jeung-myung-suh). This is from the US Embassy Seoul website. You might want to re-upload the certificate with this explanation in the notes. Sometimes correct documents are uploaded but the reviewer doesn't realize they are looking at the correct documents. Is your joint sponsor married and filing (MFJ)? If they are- you need to include W2s/1099s.

April 11, 2022: Uploaded another Korean Police Certificate (First Korean cert had a typo). April 17, 2022: Uploaded Proof of Employment and a statement explaining we were using assets as my husband's employment will not continue after we leave Korea~ Got an FE stating sponsor doesn't meet the minimum income requirement (as expected). Now we wait for the interview letter!
