Ayrton got a reaction from Gomast in Frustrated- Employment Authorization outside normal processing times
The issue that I see is that your 485 is still pending the RFE review. From what I see here in the forum, EAD is only issued after RFE review is complete and the status changes to Ready to Schedule. You don't have this status yet, and that's why your EAD never got approved.

I would focus on submit out of processing time request for the AOS, so they can review your RFE and move your status to Ready to Schedule. After that, your EAD will be approved.

It's 120 days when you send AP by itself. If you're sending both EAD and AP to receive a combo card, you can send both at 180 days. I sent mine at 175 days back in July.

That's true for letters, not for cards (GC/EAD), they are returned to USCIS.

Ayrton got a reaction from mika__ in Having trouble getting my SS# since offices are closed, what do I do I need it help
Wells Fargo will open an account for you without SSN. You can also open an account with a bank 100% online like Chime if you just want to send the money over.

When I changed my name, I mailed my EAD to the SSA to get the name updated on the card. They mailed everything back. The card arrived 1 week later.

I would send the passport with the visa, since that's also proof of LPR status. And if it gets lost, it's easier to replace than the GC.

Ayrton got a reaction from Locito in How are you going the SS offices in person?
Call other offices. You don't need to apply for it at your local one. Most people had success calling a different city to make the appointment.

I would say it's because if you do your medical in the US, you have the option to take it straight to the interview. So if you chose to do it too early, it's your fault if it's take too long to get the interview scheduled.

For K1s, AOS is a continuation of the process started in the embassy, so it doesn't make sense to require a new medical, therefore it doesn't make sense to blame us for the long wait to get the interview scheduled.

No. You show the instructions that says you don't need a new medical. Again, DS3025 is just one form out of 4 in the foreign medical, and they have all of them already. If they say you need a new medical, tell them to look up the instructions for K1 medicals.

No where in your DS 3025 should say it expires in 2 years. This is just one out of 4 forms in the foreign medical. See them as "foreign medical", not individual forms. Your foreign medical is valid forever as long as you filed for AOS within 1 year. That's the rule.

USCIS officers that are not familiar with K1 will ask for new medicals. It happened to me at my interview, I just told him I didn't need a new one, he said right and moved on.

A few people got this letter the past few months. You don't need a new one. Your medical is still valid. Print the Instructions and take it to Interview. You never had a 693, so the 693 rule doesn't apply to you. If the officer at the interview still says you need it, ask them to speak to a supervisor.

My suggestion would be to attend the interview. Let him travel. You wait for the card and apply for a reentry permit and select to get it delivered at the embassy at the place you will be staying. You can either stay and wait for the biometrics or travel and then come back for the biometrics. It would be your choice if you want to stay in different countries for couple months.

But they can leave the country after applying/biometrics (that can be waived). They don't need to wait for approval if they select to get it delivered at the embassy.

For marriage based AOS it doesn't matter what visa they're adjusting from. If it's less than 2 years between marriage and GC approval date, a conditional GC will be issued. If it's more than 2 years between marriage and approval, a 10 years GC will be issued and no ROC.
