They can't be deported for the fact that they didn't file AOS (assuming they didn't do anything to get a criminal record etc), so they are not unlawfully present or overstaying anything. It is absolutely recommended to file your AOS asap, since it will raise a lot of questions if you do it years after your marriage (and you might get denied and then deported). But since they got married a few months ago, she doesn't have to be afraid of any of the above.

It's a gray area that has been up for debate for years. The IO at your green card interview has the right to decide you violated the rules and not grant you a green card, which could result in deportation.

I know there's stories on this forum from people who successfully worked remote while waiting for EAD and got their green card, but if you want to be safe I would not do it. If the company is this fond of you, they might just keep your position for you until after you obtain your EAD.

Just pretend you are back in 2013 and forget about where you are today. You were here on a J!, you were single and you made X amount of money. Use your name and address from back then. If you owe money or expect a return you can file Form 8822 to change your address after you file. Lots of info on google.

The condition that you were in is how you will answer the questions for filing the income tax. We sometimes overthink these questions which only leads to confusion. Think literally and try not to answer the question with what YOU think they want. Just some advice. Good luck and stay engaged.

My now husband and I met 4 years before we applied for the K1, we just wrote when and how we met and that we have traveled to see each other since in about 3 or 4 sentences. We got approved without RFE (we sent pictures, passport stamps, tickets and hotel bookings from the 2 years before we applied as evidence)

Go to https://i94.cbp.dhs.gov/I94/#/recent-search, click 'get most recent I-94' and fill out all the information. Once you've 'logged in'  you can choose to just see your most current one or the history of the last 5 years.
This is what it states on the USCIS website:

For an advance parole document for individuals who are currently in the United States:
A copy of an official photo identity document Two identical passport-style photographs of yourself taken within 30 days of the filing of this application A copy of any document showing your current status in the United States  Evidence that your trip is for educational, employment, or humanitarian purposes  An explanation or other evidence showing the circumstances that warrant issuance of an advance parole document If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application  If you are traveling to Canada to apply for an immigrant visa, a copy of the U.S. consular appointment letter So I would include a letter, just to be sure to not get an RFE. I'm sure people have gotten their AP without a letter, but USCIS is allowed to send you an RFE if you don't follow their guidelines. Mine said that I'm applying in case there's an emergency in my home country and I need to travel there before I got my Greencard.

Than you wouldn't need a lawyer, but in the end you've gotta do whatever makes you feel most comfortable. The last thing you want is adding more stress to this process.

My now husband and I (came here on K1) filed K1 and AOS ourselves (we had a pretty straight forward case), but I've seen tons of people on here that have some kind of record and they still DYI and get approved. So no, you don't NEED a lawyer.

The SSN office should've given you (or your fiance) a letter stating that at this time (s)he can't get an SSN including the reason and that they will update once it's ready etc. Take that letter and all the other documents required.
It's also very normal these days to go through manual verification. I went through it twice last year (once for my maiden and once to change to my married name) and it took I think both times 2-4 weeks (don't know the exact time anymore) before I had my SSN. In the meantime I did have that letter explaining why.

Just this past week they dropped the processing time from 6-8 months to 2.5-5 months on their website. So we will see what happens over the next two weeks. The receipt date to be able to send in an inquiry jumped to March 5th and we are March 15th.

Unfortunately, AP is open-ended. It could be days, weeks, months, or even years in rare cares. There is no way to expedite it either.

Extended AP due to security checks and police checks (the USG does not trust Pakistan's PCCs) with Pakistan are common. This is typically on the magnitude of several months.

    Hi guys,

Just wanted to let you know I had my green card interview today (morning) in Philadelphia (filed September 12th 2018).

It was pretty quick, maybe 20-30 minutes. The officer was pretty stern, but he has to be. He was nice tho. He asked my husband a few questions (how did you meet, what are her parents name, where do they live etc) and then went over the yes/no questions with me. After that he asked me if I had any new documentation I wanted to add to the file, so I gave him all the shared bills, cc's etc.
Afterwards he told us he usually makes a decision in 4-6 weeks, so I was a little disappointed that we didn't get a recommendation for approval or anything and we did not know if everything was in place. He also explained what happens when your case get's approved, denied or RFE'd.

When I checked the case tracker at the end of today the status changed to 'new card is being produced' 😊

Also, for everyone who is worried about the medical. My medical expired in April this year, but I filed within 1 year after medical. The officer did not even ask for it, nor did he ask for any of my husbands documents (birth certificate, passport) He just asked for our DL's.
I did print the page from the I-693 instructions where it says you don't need a new medical if you filed within 1 year, just in case, and of course I brought all my husbands documents.

He wouldn't get deported for the fact that he does not have an unexpired passport. You filed his AOS on time, that's all that matters.

Check what ID's he can use to fly domestically. Idk if you can use a foreign DL or something, but you should be able to find that out on Google.

Worst case scenario is they don't let him on the plane cause he has no proper ID. Immigration has nothing to do with that at this point

It's a manual verification and recently more rule than exception. I had the same when I requested my SSN 2 days after I moved here. The gentleman who helped me informed me that USCIS went over to a new system and that it has caused a lot of problems verifying immigration statuses, changes etc. There's nothing they can do about it, the system simply won't let them request the SSN without following this procedure.

Mine took about 4 weeks to get my initial SSN card and another 4 weeks to get the SSN card in my married name (I applied in my maiden name and when I changed my name they had to verify again).

You can get married anywhere. Wouldn't know why you couldn't get married in the UK or the US.

After getting married you have to file for CR1, guide https://www.visajourney.com/cr1-ir1-spousal-visa/.

Please make sure you are very familiar with this process before you get married and file. RFE's / denials are easily avoidable as long as you know the process. Don't just go with what a lawyer says, make sure to cover your own butt in this process.

C90 got a reaction from Q2018 in K1 Visa & AOS Medical Exam
There's a lot of topics about this question that are very recent. You can type the question in the search bar (top right corner) to find them

To answer your question, no you don't need a new medical if you meet 2 requirements.
    1) Your DS-3025 is marked complete
    2) You filed your AOS within 1 year from your medical

The USCIS representative was right when she said that the medical is only good for 1 year, but if you meet both criteria described above, you do NOT need to get a new medical done. USCIS states this them self (https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume8-PartB-Chapter3.html), so take a print of this page to your interview, in case the officer tries to RFE you.

Don't waste your money on a new medical, unless you don't meet the criteria.

I don't want to disappoint you, but I don't think you are going to send anything in on the 7/1.

You need to get married, get a marriage license/certificate which might be doable in a week, but getting all the medical sorted out that might take longer than that...

What does her DS-3025 says? If nothing is on it (highly doubt) she probably needs to get like 8 to 10 vaccines, even tho some of the antibodies might might be tested from her blood. Not sure which ones... Also probably some of them needs to be phased out, I don't think she can get all at once...

It says it's for your I-485, so it will be related to that. But it will still freeze your I-765 and I-131 application, since they are all related and they need to do the proper background checks on all. But if you respond quickly (I send out the requested documents the next day) they should start working on your case quick again. Tbh, I don't think our RFIE had a huge impact on our processing time.

The AP is only good for 1 year and the EAD is only good for 1,5 years (including extension letter). From what I've seen lately, people who applied for a renewal for both (on time) just never got their renewed EAD/AP, what caused some people to get fired because they were not legally able to work anymore.

I see your point of the 10 yr thing (and that's fine, nothing wrong with that), but I'd rather spend an extra  go through ROC than losing my job, and I think a lot of people on here have that same mindset.

From what I've read real quick in the I-765 instructions she only has to send a copy of her current EAD card (front and back) and 2 passport style photo's.

You both need to bring your birth certificate to the interview and you also need to bring your US passport or naturalization certificate. Make sure to make copies of everything, otherwise they have the right to keep the originals. If you can't get the originals before the interview and you have copies, you can just take them and explain. Worst case scenario you get an RFE.

You can also request duplicates of the I-797's that you lost by filing form I-824  (https://www.uscis.gov/i-824). You just need to bring the interview notice to the interview.
