Adam A reacted to RJandHamid in FRUSTRATION
@Ataibna3na3 I'm happy that your visa is finally issued after many long years of waiting. Glad you found a lawyer that was helpful for you, however, there isn't much lawyers can do in regards to administrative processing due to the DS-5535 form. It's an extensive background check that generally can't be expedited, even with the intervention of a congressman or lawyer. It's mostly a waiting game.
The good news for OP is that most DS-5535 cases are eventually approved, though it make take several months to over a year of waiting.

Adam A reacted to SalishSea in Can contacting Senators/Congressman help with visa process?
You can use google to find the websites of your state's two US senators, and your congressional representative (by zip code).
Their websites all contain info on getting help from federal agencies (such as USCIS), usually a downloadable privacy release form.
Keep in mind they are often not able to get any more info than you are, and that they cannot influence or hasten a decision.

Adam A reacted to John & Rose in John & Rose
All here and well. Here are my kids with Rose's. So far so amazing. Got them phones with unlimited data (they don't believe they won't need to get loads) and Aira is signed up for high school. Thanks everyone.

I think this is what the OP doesn't understand. That it will be a denial that she will then have to address. So much easier to come prepared.

Adam A reacted to Greenbaum in US Visa Interview with a 221G Administrative Processing Result
Your'e up against a governmental agency that will use throughout this process, the less information we provide the less information we have to defend. They don't have the time to get into a argument with an applicant. It's not productive. They have their guidelines and more times then not the applicant's approach is usually emotional. I see it here all the time on VJ. Ppl believe they are entitled to a visa because ____________. Fill in the blank. Ppl are waco with their demands. I have to take the side of USICS, NVC and the Embassy. It's their process, and it works. Give them what they want, and if you are not a "bad guy" wanting to do harm to the US, there is a very reasonable chance you'll get your visa. JMHO

Horrible story. What a tool.
No way to remove it. It was used/cancelled on entry but will be in your passport until you renew.

Adam A reacted to JeanneAdil in DV 2019 winner - settle down in 6 months
no one here is going to tell you to do the unthinkable
either you want to live in the US or you don't
asking a friend to get the green card and mail it is a poor idea (if not illegal)
you were lucky to win
why not come and look for work ?
if you decide not to stay , return the green card and go home
a visa is not a given right to anyone
it is a gift
let someone else have it that really wants to live here

Adam A reacted to SalishSea in How much time
This is what we have been trying to tell the OP, who remains convinced it will only take a week or so if she shows up without the required documents.

Things always change. You can't rely completely on one other application as your rule of thumb. Statistically speaking, that's a very low sample size.
The application is different
The Petitioner and Beneficiary are different
The immigration officer/interviewer is different
The questions will likely be somewhat different.
My husband did a naturalization application. It took 10 months and his interview was stressful. A peer of mine did an application for his mother for the same local office, she was initially rejected, had to do second interview and it took > a year. Someone who reports to me did an application right after my husband and he was approved and took the oath within 2 months Three examples, same local field office, three totally different experiences.
There is no way to predict 100% how long you would have to submit it but if you end up in Administrative Processing, it could take a while (I agree with the 1 year as a possibility provided previously).
If your family member is hestitant, have them provide sponsor documentation in a sealed envelope to you to bring with you. If it's needed (sounds like it will be) unseal and hand over. If not needed, you hand the sealed envelope right back to the family member afterwards. But you really need to bring that affidavit with you. Don't give the the consulate a chance to deny it based on finances.
BTW, I understand you are stressed but the people on this forum are trying to HELP you.

So as long as you accept the fact that doing it your way will likely create additional (unknown duration) wait time for the visa, feel free. And please let us know how it turns out.

One more thing, @Karry. I seem to remember that you said there is no current US income.......I see no reason to think that you will avoid having to have a joint sponsor. I'm sure you WILL need it......

This is a public forum. We try to give information from all angles. Most people appreciate that. Your case appears to be a little uncertain. You are free to accept or to ignore what other posters suggest....

Adam A reacted to Nitas_man in How much time
Our DCF instructions required bringing the affidavit in person to the interview. It is highly likely that yours also says that. If you know you need it and do not bring it with you then chances are high that you will have to go back.
Your joint sponsor will be needing to provide it to you to bring or you will need a sponsor who trusts you enough to provide it. No amount of frustration or all caps posting will avoid this requirement.
Option 2: Wait until your spouse has the means and financial ability to sponsor you.

Adam A reacted to Crazy Cat in How much time
I would find another willing, qualified joint sponsor and have everything ready at the time of the interview. It sounds like your joint sponsor is hesitant.

Adam A reacted to Loren Y in your experience with complaints made against USCIS
Where USCIS files all complaints photo below. Understand this trash can is way too small for the number of complaints against them. There is none, zero, zilch, accountability. Welcome to the United States of America. Sorry to be so blunt, but sometimes that's the best way.

Adam A reacted to JeanneAdil in Post-Interview: Passport required to travel
you hold a Pakistan passport??? right??
if you travel now before getting the visa and return the passport to the embassy, you will be months in AP as there will be new security checks for your travel
being from a high fraud country , you need to walk on egg shells to finally get the visa
i would cancel any travel plans and wait this out

Adam A reacted to JFH in Sticky Situation?! Easy Resolution?!?!?!
I know you are trying to help but please stop scaring her and giving false information. There is nothing wrong with them sending the I-130 tomorrow to the lockbox (assuming they have all the supporting documents to hand), wherever in the world they happen to be. Her husband’s overstay in the UK will have no impact whatsoever on the situation. Where they mail the package from is completely irrelevant. The only “character issue” that stops a USC from petitioning is a crime under the AWA. We have nothing like that in this case. If they have the money and the necessary documents to file, I would urge them to get that stuff in the mail immediately.
British citizens cannot travel to “all commonwealth countries visa-free”. We need visas for India, Australia, Canada, Bangladesh, Pakistan, Sri Lanka, Sierra Leone, Ghana, Nigeria, Rwanda, Tanzania and Uganda and possibly a few others. These are all commonwealth countries. Some of them issue visas on arrival. Others require a full application process. I think you are confusing the commonwealth with the EU.
We also don’t file taxes in the UK. We have a PAYE system.
It does not require notarized copies. It only requires photocopies.

Adam A reacted to portorusa in Annulment/Divorce from K1 after 3 months of marriage
Annulment is very difficult to prove. Especially on the grounds of fraud.
Why are you so sure that he had lied to you, anyway? Do you have a document to prove it? Like something in his writing to admit he had lied?
Have it ever occurred to you that he honestly hoped for a good marriage of a life time with you? That he, too had his dreams and expectations and honestly hoped for the best? Like you, he was sure he was in love and that things will be wonderful with you?
But it did not work out as he hoped. And he is disappointed and hurt, just like you. He realized that a real life turned out to be different and that he was not happy with you.
And then he did the right thing, and moved out.
If he stayed and pretended that everything is hunky-dory and waited to get his green card, and then moved out, that would have been fraud.
Instead he ended the marriage before getting his green card. Moreover, he expressed his wish to return to his home country.
I think your ego screams “fraud” because you are unwilling to admit the truth, that the marriage failed, and most likely not only because it was his fault, and his fault only.
Just divorce, withdraw your Affidavit, and move on.

Adam A reacted to samnrong in No Letters of intent to marry K1
Additionally, you mentioned that you had an attorney prepare the packet for you. This is a HUGE miss on their part and I would request a refund from them. If they do not offer you a refund, I would report them to the BBB.
Since they are advertising themselves as an immigration attorney, this is absolutely something that should not be missed. A simple google search or visit to the VJ forums will show that these letters of intent are critical pieces of the application. In fact, I believe the USCIS website and I-129F form instructions even indicate that this is required evidence. The fact that your attorney missed this is inexcusable for a professional and borders on professional negligence.
Personally, I would demand a refund. At a minimum, I strongly suggest that you terminate their services and use a different immigration attorney going forward. The fact that they missed something so simple as this on the I-129F application is a huge red flag and I would not trust them to get anything right whne the potential issues get more complex.
Good luck!
