I can totally relate having lived this within my own family and having biracial children and multi-cultural home.  I'm so sorry you are going though this abuse..you don't deserve it.   I'm glad your husband is supportive but he needs to cover you, protect you and unfortunately stand up to his mother.   You are his wife and she needs to respect that.

No reason for the change in terminology other than they just got around to changing it.   Your case has been in AP since your interview.   Until they complete their review there isn't much you can do.  AP has no timeline.   You can have the petitioner contact the local Senator or Congressman to see if they can get a more detailed response from the embassy but it won't speed up the process.

As others have mentioned you have to be careful how you answer questions.   Even if you call someone your sister when asked in a setting like you were in he day of the interview you must answer what she really is (your cousin) not what you feel she is.   It may not have seemed like a big deal to you but in the eyes of he officers deciding your case it most likely raised even more red flags.

Her birth certificate is wrong and off by 4+ years?   Being from a country that will scrutinize I would not jeopardize your chances by hiding things.    One of the biggest issues with immigration from a foreign country is documentation.   You can't just accept a document is wrong but not attempt to correct it.  Not registering a marragie does not make you any less married.   My recommendation would be to correct the birth certificate and apply for a visa category in the future that you would qualify for.

It means your case is in Administrative Processing.  If they send you an email pertaining questions expect a long wait.  I wish their was a more detailed answer that can be given but unfortunately no one can give you one as Administrative Processing is different case to case and the time line varies.   After 60 days send an inquiry to the embassy to check on the progress and keep your eyes open for emails.

If you click on your ds260 and open it up to view it there is an expiration date on the top right.   If it reopens it says reopened instead of completed and you'll be able to edit it.

You're welcome!   I also recommend that in any letter that also poses as a sworn statement you add the under penalty and perjury statement.

There is a case in the old thread.  He was a musician and was in several countries.  He has his visa now but it was a very long wait.

If you show up to a K-1 visa interview with your wife that's were the problem would arise.

    For Senators try these:

    https://www.harris.senate.gov/contact/email

    https://www.feinstein.senate.gov/public/index.cfm?p=immigration-casework

Fill out the request forms and they will get back to you.

Congressman is a little tricky you have to know which one works for your district.  Once you find out you can contact them the same way.  Someone here from California maybe  able to shed some light on it.  I know with mine I contacted the what I thought was my local representative but they forwarded my case to another congressman in Harrisburg.

From your embassy's P3 letter it states:

PASSPORTS: Bring your current passport and all former or expired passports. Your current passport must be valid for at least six months from the date of your planned arrival in the U.S. and should reflect your correct name and date of birth. All children, regardless of their age, must obtain their own separate passports.

If you do not have an older passport that is lost then an explanation at the interview may suffice. Most embassies are understanding for lost passports. If you have a police report then bring it along to the interview as evidence.

Yes it was an entire HOUR. The first few posts also state 2 visits.
Im annoyed that you arent paying attention to what the OP has written and then your advice is not correct for the individual.  While you and your spouse, who share this account, can give quality information on high fraud consulates and long visa journeys (in your case it was two, the K1 AND the CR1), it you arent going to pay attention to what someone writes, that information will be inaccurate.  The entire visa process is about paying attention by reading thouroughly, interpreting literally, and answering honestly, completely, and in a concise manner.
We promote that here, and its hard to promote that atmosphere when you don't even bother to read what the OP has written. Please be more diligent.

Yes.  There is a member I met on here we talk on facebook.  Her husband was in AP in Islamabad for 2 years she filed a WOM and it was returned to USCIS for not enough evidence of bonafide relationship.   The NOIR did not mention anything about not completed back ground checks which some will say on here would be the reason for the return.

It's forcing the embassy to make a decision not USCIS.  USCIS has already approved the petition.  Embassy places the cases in AP that has no timeline after waiting a year or two at embassy level a Writ is the only way to get things moving.   I have seen some petitions returned to USCIS as a result but lately I have seen approvals of the visa.  Not enough evidence for me as of yet to consider but it is in the back of my mind.

Even simple cases have had very long AP.  Every case is different and there is no way of knowing how long your case will take to complete.   Last year cases were being approved in about 6months time a few months ago people were looking at a  year but lately things have been moving along again.   It's really hard to tell.

Our second interview was in October (when we received the questionnaire) We had several updates the first few months  but  stopped in January.  After that it only updated when an inquiry was sent.

Today our case updated for the first time since January on its own.   We are hopeful that it's a good sign and Inshallah this nightmare will be over soon!

It really depends on the embassy.  Some embassies do not keep the passport during long AP but will request when needed.  If you interviewed in Islamabad however it would be a bad sign if they didn't keep it.    Germany I'm not sure.  I would read others stories (who have interviewed in the same embassy and have also been put in AP) to see if keeping the passport is a trend there.

Due to the fact that a Muslim (even if she is not practicing the family believes she is) woman marrying a non-muslim man isn't even legal under Islamic Law it would make total sense to the Consular officer as to why the family does not know about the relationship.   I'm not certain if the it would cause any issues at the embassy stage but I would make sure they know that she is no longer practicing.   You will not run into issues in the earlier stages.  In the meantime perhaps you can gain some insight from others who have been through that particular embassy before your interview takes place.

    Good luck to you!

They may have set up a payment plan to pay the taxes within one year but that would mean that their return was complete and they should be able to provide the transcripts.

After requesting a second medical and making us wait about 50 days, it updated today, it says "returned to NVC"

I guess it's not meant to be. I am just really numb right now.... if you were going to reject someone don't make them wait a fuk*** 10 months after the interview

I think the date is for them not us and has no correlation to how long our case will take.  It's the form itself that expires.

I'm just confused that since 2017 never once has our ds-260 reopened or have we been asked to update it.

    Assalamualaikum Brother,

Since it's not culturally normal I'm not sure how easy it would be to get such a document.   I only know of one instance in Pakistan where my husbands cousin from his fathers side asked for his aunt on his mothers side hand in marriage.  I think she was 20 years older.  So although the Pakistani boy chose someone in his own culture of that age difference his family did not allow because his father wanted grandsons.   So does it happen in Pakistan?  I'm sure it may but is it a cultural norm?  I think not.  You may have to contact a multitude of agents to gather enough data actual historical occurrences would be helpful.

Another big issue you have to overcome is the fact the embassy thinks you are already married.   Have you provided your families FRC?  Can you get a document from NADRA listing your history? Statements from family stating you were not previously married will not be enough.

Lastly more FaceTime....  Before refiling make sure you two have spent more in person time together.   Not seeing each other in person for as long as you both have did not help your situation at all.

Please take the advice given if you file based on similar evidence you have given in the past you are setting yourself up for failure.

    Good luck to you!
