ImagineMe reacted to Greenbaum in Form I-134 Affidavit Of Support
    The Embassy letter states:

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form K1/K2 Interview Preparation Instructions – English (February 2014)  Page 3 of 9 with original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134.

Gather the supporting documents and the I-134 and send to the PI. Best to send either DHL or FedEx. Don't send it via USPS! It will not arrive in time for the interview if it even arrives. Can't trust PhilPost.

ImagineMe got a reaction from Diane and Chris in Refusal letter 221 g
Yeah as far as I know, a 221g is not a refusal letter, but something stating they need that information requested before they can move on. My fiance got a 221g paper because her exam hadnt arrived at the consulate because she only did it 2 days before the interview. So they told us that the exam will be sent to the consulate and she will have the 221g to submit her passport once they get those documents and she is ready to get her visa, as we were approved. So I don't think it's a refusal.

For reference, a 221(g) is a refusal. However, it's what many call a "soft" refusal as it can often be overcome via providing additional documents, waiting for checks to complete, etc. Refusal under section 221(g) of the INA is basically saying that the visa application is incomplete so they are unable to determine eligibility for the visa yet. Fixing whatever is wrong with the application (i.e. providing additional documents) lets them determine eligibility and make a decision on the case.

Those are not inappropriate questions. There’s only so much planning you can do for a wedding on a K1. However, from the likes of it he just wasn’t satisfied with the evidence you had to show you are a bonafide couple. You didn’t get denied. You were just requested more evidence. Gather as much as you to show you two are a real couple and send it to the embassy.

ImagineMe reacted to Nitas_man in Medical exam taking 1 week for results
Not possible (one day).  The results aren't in for about 3 days and the doctor can't fill out all the paperwork until the results come in.

Flights a week out might also be pushing it.  1-2 weeks for passport in hand with visa is a more reasonable expectation, there's some processing and data entry after the interview that takes a few days.  It is very likely that the flight will need to be pushed out probably an (at a minimum) additional week.

I never heard of getting a visa medical packet same day of exam.  Someone here told you that?  Some of the tests take 3 days to run.

Advice:  Attend the interview, drop them at the consulate sometime after the interview.  You need the medical results for the visa, not for the interview and this is also what the consulate will very likely advise you to do.

After my wife's medical, I picked the medical results up 4-5 (business) days later.  A week sounds about right.

I may be way off the mark here, but they sent this to you via *email*?  And they expect a response by just filling in and sending as a reply???

My SPAM/SCAM/Identity Theft spidey senses are going off as an IT administrator, especially considering that there is quite a bit of personal, confidential information in the form - just the kind of stuff that is about perfect for an identity thief.  My gut reaction would be to call the originating source and verify that they actually sent this, and everything is expected to be returned that way -- for me, this type of a message is a HUGE RED FLAG.

Do you have the ability to see the raw message/message headers in your email client?  That at the very least would be a bit more helpful in determining if the message originated where it appears to have originated.  Also - if you do decide to fill in the form and send it the way that they indicate, make sure you look at the To: field as it gets filled in on your email program - a common trick is a Reply-To header that makes the reply go to somebody completely different than you expect it to.  This can be a legitimate address, but it is also used by scammers...

You can message me directly too (I believe that is possible here) if you need further help in trying to determine the validity of the message based solely on the data in the message...

If this does turn out to be legit...  Somebody *really* has to take a look at the policy for sending such sensitive information via completely unsecured methods...

When we did my K1 the whole process took like 9 months. And that was in 2011. Trump was not even near D.C at that time.  Now everything takes like a year or more. The waiting times usually get longer and longer, not shorter. That is with everything.
Do not plan anything on stone until she has her K1 stamp on her passport. You can always do a quick civil ceremony at the courthouse (in US) so you can start with the AOS and then plan a bigger ceremony for family later on, etc.
Remember when it comes to immigration, they do not accommodate your schedule, you do theirs.

ImagineMe reacted to Mrsjackson in SSN before marriage upon entering US?
    Hello,

I am going to enter the US with my K1 visa in about 2 weeks. I’m a little confused about exactly what steps to take after. I know I need to get a hold of the I-94 right away. I’ve seen some people on here say that it’s best to get your SSN right away as well, however wouldn’t it be better to wait until your marriage license is issued and you have your proof of name change? I don’t know why it would be better to get the SSN in my maiden name only to have my name change shortly after? Any insight appreciated.

Look at this poor sap who got married, filed for AoS for his wife, then a few months later they left the country to do a Catholic wedding ceremony, and upon trying to re-enter the US, the wife was denied because she left without having advance parole approved. They thought they would be ok because their green card interview date was for later that same day! It is not unreasonable, if one does not know any better, to think CBP would let you into the country to attend your residency interview that day, but one more reason why it pays to understand this process fully.

I feel sorry for them, they must be in so much pain and kicking themselves. A good reminder that we are lucky to have found this site to avoid such mistakes.

Thank you both, @Bzlibem and @ImagineMe! I guess I panicked too early because I got a text and email notification about 40 minutes ago saying the response was at the post office in Laguna Niguel, and then a second notification about 10 minutes later saying it was ready for pick up.

No one gets the original birth certificate. That stays locked away in the records office as it is the only record of the birth. What they mean is a certified copy, not a photocopy.

August 3rd filer, NVC contacted me via email on may 21st to give me case ID and it told me they are expediting to the Seoul embassy. Its still in transit. Now do they automatically schedule the interview? Wen and I filled out and submitted her ds160 last night. So im waiting for her to get her packet in the mail before I do anything else. Plus we are still waiting on her police certificate from Korea and her birth certificate translations. Had hoped for an early June interview, but not likely to happen esp if the embassy schedules it and not us.

Can't emphasize how important this advice is.

    1. Divorce your current wife NOW. To be honest I don't know why you haven't already. Staying married has put you in major risk, especially since AoS has not been filed. She cannot file AoS if you divorce her NOW.

    2. Do not ever ever ever ever ever talk to her or see her. If SHE tries to contact YOU, write down the date, time, location and what was said.

    3. Divorce her now.

In my opinion, (and for anyone else reading this thinking about whether they should apply for AP or not) AP is always good to submit when filing the AOS concurrently even if you don't have any travel plans in the near future.

Too many people have been caught unawares by real emergencies back home and all of a sudden need to travel for a funeral, sick relative etc.  One less stressful thing to worry about if one gets it out of the way in the beginning, so-to-speak.

You could always apply for Advanced Parole and submit that application at the same time---that would allow you to travel/re-enter the US (without the presumption of automatically abandoning your application) while your AOS is pending.  AP takes about 3-4 months to process.

Or, have a small "weekend" honeymoon somewhere nice in the US and save the overseas trip for later.

August 3rd here. Finally got approval April 26th although it didnt show up on the website til yesterday the 27th. I had gotten tired of waiting and scheduled my flight May 3rd to see my fiance in her hometown of Guangzhou. Guess once we both get back to our homes, we will have to start part 2 of the process and I will have to schedule another flight once she has her interview date in Seoul since I want to join her. She has lived in South Korea for the past couple of years so thats why we chose Seoul for the consulate.

Ok, so finally we got approved. I guess the Discoverture Statement and Sworn Statement signed by her, along with a statement from me explaining that the White Book divorce document was all they can get from the Chinese government, worked to complete the RFE info. Took 5 weeks after they recieved the RFE reply. Talk about major backup. But we cleared that hurdle.
