AnaidAaron got a reaction from Valmabe in Applying for SSN before Marriage and AOS for K1
May I ask what could I use as my 2nd identity document?
I found this link but it's not quite clear to me https://www.ssa.gov/ssnumber/ss5doc.htm
I imagine my birth certificate or driver's lincese from my country could work, but do I have to get certified translations?
    Thank you!

I can’t upload the picture for some reason but basically USCIS will accept your form with our without the barcode, it just means they will have to type it in manually.

I agree that they were lucky, but not in the sense that you mean. They were lucky enough to get an adjudicator that knows the policies for those adjusting from a K-1. Some apparently do not know their own USCIS policies, or the medical showed a condition. For a K-1, it is not supposed to matter if the exam is over a year old. They only had to file for AOS within a year of the K-1 medical. Many are not required to get an I-693 at all, ever. They are not supposed to have to follow the same policy for those getting an I-693 within the US and needing to have the medical within a year of adjudication. Some are asked for it anyway, an some are correctly not. >>>

    4. K or V Nonimmigrants Applying for Adjustment [26]
K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:
•The medical examination did not reveal a Class A medical condition; or

•The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions.

Can begin filing at the end of January, workers called back from furlough.

But either way, until April, no one can demand a new tax return since you don't have to file it until then.

Probably not, that's why it's very, very unlikely that USCIS would make a problem out of it. 2017 tax return is the most recent for now, just send that (and 2016 + 2015, but that's only optional!)

I think I read somewhere that the shutdown doesn't effect IRS yet, but if they're still in shutdown around March/April it could cause a delay for getting your return payed out. I only read this online, so this is not a very reliable source lol. Financial advisor would know best.

Yes, and explain that you met the visa requirements by marrying within 90 days but failed to maintain status.

Ignore the stuff about the ITIN.  Look at the two choices to file.

    1.  The US taxes on worldwide income, so you're either in or out.  If you worked in 2018, you had worldwide income.  Your husband can file jointly with you and you can volunteer to be treated as a resident which means your worldwide income is subject to US taxes.  Alternatively, he can file separately and you file nothing.  Those are the two choices for him and you.  When the foreign spouse has little or no income, it's better to file MFJ.  When the foreign spouse has significant income, then it's time to do it both ways to determine which is the better result.

    2.  You have a SSN, so you do not qualify for an ITIN.

    3.  With a SSN, you can efile in CA.

    4.  Your husband can not file as single since he's not single.

    Read the question
" Have you ever violated the terms or conditions of your nonimmigrant status? "

The visa wasn't violated. The status was by overstaying.
"I came on a fiancée visa and my 90 days already ran out"\

Edit: An overstay of even 1 day meets this criteria as noted in the USCIS Policy Manual (https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume7-PartB-Chapter4.html). It won't impact the outcome (nor would an incorrect answer since it's not material), though.

    Yes.
K-1 overstay is fine. So is K-1 Visa Holder. It won't impact the adjudication. You'll be fine.

Staying in the US beyond your I-94 without any other legal status or authorized stay would be a violation of status.

I'm in a similar situation. I'm a USC married to Mexican who has been in the US since August 2018. We married in December. He is considered a US Resident Alien for tax purposes due to the substantial presence test (more that 183 days present in US during 2018).

Before coming to the US, he had income and paid taxes in Mexico. We are filing MFJ. Because of filing MFJ, we must include his income from Mexico with my income on like 1 of 1040. This is called "worldwide income." In order to prevent double taxation on his income in Mexico, we are filing form 1116 Foreign Tax Credit. It's a little complicated, but read the instructions thoroughly and you'll figure it out. Form 1116 helps you figure out how much of a credit you can take on your foreign taxes. You are not required to provide any prove of what your foreign income was, or how much foreign taxes you paid, but you should keep these records in the event you are audited.

If you don't have any foreign income for 2018, then your situation may be even easier.

Here are the forms I will file for 2019.
    2018 1040
2018 1040 S 3 (Schedule where you input the credit figured on form 1116)
    2018 1116 Foreign Tax Credit

    Best of luck!

I don’t recall paper filing the first year.  Thought we e-filed.
Either way there is a huge tax benefit to filing MFJ vs. MFS.

He cannot file single.  I am also just married this year, but I think (if I remember correctly from my previous marriage) that the bigger tax break comes from married filing jointly, rather than married filing separately?

AnaidAaron reacted to Wuozopo in I-693 help! Being told I need another physical exam by Civil Surgeons
It wouldn't be a second interview. It would be more like, "You need a new medical exam by a civil surgeon. Get that done and mail the sealed envelope back to this office and I will finish up your case."  It would go straight to your local office.

Be aware that there are generic letters prior to your interview telling you what to bring. It can say I-693 if not already submitted. That's not an RFE crafted just for you. You have a medical exam and shot record on file that should take the place of an I-693. Wait and see what the live person doing your interview says. He should have all the original medical results in the file.

AnaidAaron reacted to K1visaHopeful in I-693 for AOS
The I693 does not apply to K1s provided you submit your AOS within 365 days of completing your overseas medical, have completed all the vaccination requirements and have a completed DS3025 from that overseas medical. You will only need to submit a photocopy of your copy of the DS3025 with your AOS application as your medical packet was already submitted to DHS at your POE and will be transferred to USCIS for your eventual AOS interview.

The information you are quoting is valid for immigrants who have not had a medical completed at all. So yes, another type of immigrant can choose whether or not to have a US Civil Surgeon complete a medical and sign an I693 for them within 60 days of AOS application or they can choose to wait until they receive an interview appointment to complete a medical and obtain a signed I693. In either case, that medical would be valid for 2 years from the date of the medical exam. In some cases, 2 years is not long enough. Ie they would have to wait MANY years for a chance at a greencard therefore it would be advantageous to wait until way later to obtain a medical.
Understand that there are many types of immigrants using this same I485 form. K1s are the minute minority so the instructions are mainly for the most common immigrants filing AOS.
If you want to learn more about the details for K1s other than what I have posted above I would suggest checking out the USCIS policy manual.
Everyone must receive a medical exam and vaccinations to apply for AOS. It's just that we as K1s have already done so so our procedure to follow is much different.

Correct. You would not be required to submit an I-693.
The IO can still require a new medical exam + I-693, but this is not common unless there is cause for them to request it.
