When is the GOP going to get off their high horse and get down in the mud with the Left using their tactics? I believe this is why DC hates Trump so much. He will use the Democrat tactics against them and upset the normally demure Republicans.

  4. 1. No, a re-entry permit is not the same as the AP although both use the same form for the application. When planning to stay outside the US for more than a year, she should file an I131 for a Re-entry permit, and she has to remain in the US until the biometrics are conducted. 2. The expired 2 yr GC and extension letter is your wife’s proof of US LPR status. She can use this to board a plane back to the US, but see 1 if she plans to remain outside the US for more than 12 months as an LPR. 3. Re-entry permit biometrics are a separate process. USCIS may Re-use recent biometrics, but when she files for the re-entry permit she should remain in the US until her biometrics appointment, or until she receives a notice that USCIS will be re-using biometrics. 4. Yes 5., 6. and 7. Not sure 8. The ROC will remain in process, but if you are called for an interview you may both need to return for it. Good Luck!
  5. Overall, the I751 ROC is just a royal pain. @Mike E summed it up very well, and my feelings are very similar. Like others have stated, if possible, have your spouse enter after the 2nd wedding anniversary. The CBP officer should stamp the visa with an IR1 notation even if the visa says CR1, but if this does not happen, USCIS should still issue a 10 yr GC. If USCIS screws up, you can file an I90 for free to get the card corrected. My only other advice, if your spouse does enter after the 2nd wedding anniversary, have them pay close attention when being processed, and even though no one is required to offer information to the CBP officer(s) (only need to answer their questions honestly), it doesn’t hurt to remind the officer at the POE that you have passed your 2nd wedding anniversary.   6. No, the extension letter only provides proof of your LPR status with the expired 2 yr GC until the I751 is finalized. I will defer to @mindthegap as the expert on the complicated I751 situations. In my opinion, the easiest would be to get the divorce finalized as quickly as possible (do you have an idea how long it will take) and then send in a divorce waiver request with the divorce papers. But if the divorce is going to take a year plus, that may be risky. I am not sure about pulling the current I751.
  7. Doesn’t appear that has happened yet based on the timeline. It seems they only have the 4 yr. Extension letter with an expired CGC. To the OP, since the divorce is not finalized yet, I would just wait until you have the final papers, then notify USCIS that you are changing the I751 to a divorce waiver. That is a bit risky as if the I751 is approved without a divorce waiver, it could cause issues when you file the N400, but since you only filed in March or this year, you should have some time. When you have a good idea when the divorce will be finalized, then you can notify USCIS of the divorce waiver about 90 days before it is finalized, and reply to the RFE with the divorce papers. As to N400, you will be able to apply in a couple more years under the 5 yr. Rule. Good Luck!

  15. In general since they will be categorized as F4, the I130 will be slow walked for 15+ years. We filed an I130 4 years ago for my stepson and his wife as F3, and there has been no movement. Good Luck!

  17. Personally I like a hybrid system. It is a nice change of pace to go into the office 2-3 times a week, and it is also nice to be flexible in case something comes up. What is interesting is being one of the older folks on the office, I totally like the whole open office environment, I work with quite a few millennials that wish we had cubes.
