  1. I think we are getting close to a parity point again where either parent staying at home to watch the kids might be cheaper than paying for daycare. Of course there are other cultural factors involved, but cost is a big factor.
  2. When you file the I130, you only need to provide proof you are qualifying relatives such as providing both your and your siblings birth certificates showing you have the same parents. The affidavit of support will come much much later at the NVC stage when the petition is sent to the consulate for an eventual visa interview. How old is your sibling? If they are relatively young (under 10) it might be best to sponsor one parent, and then have them get their LPR status and they can petition for the other spouse and child under F2A which is currently running about 6-8 years.

  4. I can see that being a big deal especially with a lot of remote workers returning to the office and in need of childcare. Makes it tough for those that are not able to work remotely, although I suppose a lot of patients wouldn't mind having dental work done online.
  5. Not a real good idea to get any tickets before a decision is made on the visa. The main things she will need is evidence of her ties to her home country to show she needs to return after her visit. I am not positive if they deep dive financials for a B2 like they do for say a student visa.
  6. IR5 does not allow derivatives, so you would file an 2 I130's one for each parent, and one I130 for the sibling, but the sibling would be F4 and take a lot more time. That being said, it does not hurt to get an I130 in the system for your sibling.

  14. You can help her fill out the DS160 for a B2 visa, but in the end it is her application under her own merits. As @Boiler stated, no sponsorship or invitation letter is needed.
  15. Anything said verbally at an interview or given as a handout at the interview is "conditional". Until the system states "Issued" or you actually have the visa in your passport, there is always a possibility a supervisor could change or delay the final decision. That being said, it is a good sign the interviewing CO gave you a verbal approval. Good Luck!
  16. If you USC spouse moves to a new address, then answer truthfully, explain your spouse moved since the DS260 was filled out, and the CO can update the information accordingly. Just make sure you have the new address when you go to the interview. Good Luck!

  22. 1. No, a re-entry permit is not the same as the AP although both use the same form for the application. When planning to stay outside the US for more than a year, she should file an I131 for a Re-entry permit, and she has to remain in the US until the biometrics are conducted. 2. The expired 2 yr GC and extension letter is your wife’s proof of US LPR status. She can use this to board a plane back to the US, but see 1 if she plans to remain outside the US for more than 12 months as an LPR. 3. Re-entry permit biometrics are a separate process. USCIS may Re-use recent biometrics, but when she files for the re-entry permit she should remain in the US until her biometrics appointment, or until she receives a notice that USCIS will be re-using biometrics. 4. Yes 5., 6. and 7. Not sure 8. The ROC will remain in process, but if you are called for an interview you may both need to return for it. Good Luck!
  23. Overall, the I751 ROC is just a royal pain. @Mike E summed it up very well, and my feelings are very similar. Like others have stated, if possible, have your spouse enter after the 2nd wedding anniversary. The CBP officer should stamp the visa with an IR1 notation even if the visa says CR1, but if this does not happen, USCIS should still issue a 10 yr GC. If USCIS screws up, you can file an I90 for free to get the card corrected. My only other advice, if your spouse does enter after the 2nd wedding anniversary, have them pay close attention when being processed, and even though no one is required to offer information to the CBP officer(s) (only need to answer their questions honestly), it doesn’t hurt to remind the officer at the POE that you have passed your 2nd wedding anniversary.
