    OP,
To answer your original question "What did everyone else send along with the AOS?" here's what my husband sent:
G-1145 Payment in the amount of $1070.00. I-485 with accompanying documentation: Photocopy of the biographical page of his Brazilian passport Photocopy of the K-1 visa page of his passport Photocopy of I-797, Notice of action from U.S. spouse’s I-129F Petition I-94 Photocopy of his birth certificate and translation Original marriage certificate (The instructions say a photocopy is acceptable, but we had seen other cases on VJ where an RFE was issued because an original was not sent, so we decided not to risk an RFE and sent an original) Two passport-style photos G-325A and Supplement: Applicant’s employment last 5 years I-693 with a photocopy of DS-3025 (He needed a flu shot to complete his immunizations) I-864 with accompanying documentation: Photocopy of U.S. spouse’s birth certificate Photocopies of U.S. spouse’s IRS tax transcripts for the previous 3 years A letter of employment from U.S. spouse’s employer Photocopies of U.S. spouse’s Statement of Earnings for the last 6 months I-765 with accompanying documentation: Photocopy of the biographical page of his Brazilian passport Two passport-style photos I-131 and Supplement: Part 7. Complete Only If Applying for Advance Parole Photocopy of the biographical page of his Brazilian passport I-94 Two passport-style photos We did not receive an RFE, and our case was forwarded to California for processing--we never had an I-485 interview.
    Hope this helps.
    Good luck in your journey!!

I would recommend printing the transcript from the IRS website. You want to select Return Transcripts.  You could, instead, send a copy of the actual 1040 your co-sponsor filed, but if you do that, you would need to include copies of all the additional forms he/she sent with the 1040 plus copies of all W-2s and all 1099 forms he/she received.

My husband, who is Brazilian, had no issues when we applied for a K-1 visa as a same sex couple.  Same-sex marriage is not universally legal in Brazil; it is based upon each state's laws.  I agree with others who have written that you are dealing with the U.S. government, not the Pakistani government.  However, since Pakistan is such a difficult embassy, be sure to front load your I-129F petition.  Here on VJ, I've read of too many cases in Pakistan where the CO refuses to look at any additional evidence brought to the interview and denies the visa.  To improve the chances of success, plenty of face time is advisable.  Try to have more than one visit.  Where possible, include airline boarding passes, chat logs, email transcripts, pictures together (especially with family), receipts for hotels, meals, sightseeing, etc.  You might even include affidavits from your fiancee's family saying they know and approve of the relationship.

    Good luck in your journey!!

I forgot to mention, also include photocopies of all your passport stamps that show either of you entering and leaving any country at the times where the two of  you were together.  These lend credence to the receipts you include.

Unfortunately, no one can predict what will happen in the future.  Currently Venezuela is not one of countries affected by the the latest travel ban, with the exception of certain specified Venezuelan government officials.  Presumably your fiancee is not one of them.

All you can do is hope that her visa will be approved and she will be able to get to the U.S. before (and if) any possible changes might affect visas being issued from Venezuela.

Depends on which city the job is in in Germany. If it's in Frankfurt, you can. We live in Berlin and couldn't DCF.

If you take the job in Germany, you could cancel the K1 and then get married. Then, you can live in Germany together (my husband and I did just that and neither one of us is German) and file for the CR1 from abroad.

@JFH has the best advice, IMO.

Arrange for your wife to join you in Germany for the next few years. When the time comes, then you can file DCF from Germany to bring her here.

Continue reading the news, though in all likelihood you will be fine.

I've gotten on this soapbox here before, but here goes: right now isn't a great time to be an immigrant in the US. Black, white, brown, orange, dayglo, documented, undocumented, man, woman, whatever... it's not awesome. Obviously, white males have it the best, because we can pass for American until we open our mouths, but not everyone gets that privilege.

This anti-immigrant sentiment has been bubbling under the surface here for some time. From Dubya's proposal to instantly criminalise everyone illegally present in the US about a decade ago (that he later backed off from, as I recall), to the at-first-subtle-and-then-less-so wave of pro-American/anti-immigrant stories you started seeing pushed after 9/11 by Fox News and the right/far right, it's been a work in progress for a while. Trump certainly didn't invent it but he is capitalising upon it.

I think in the long run this will go one of two ways: it will other start to swing the other way, and we'll see more Democrats in office who at least ostensibly seem to value people being seeing as people (shocking, right?) -- including immigrants -- or there will be a doubling-down of the current situation if Republicans are able to consolidate their power over the next couple of years, and you will start seeing more restrictive policies on immigration, such as (more) restrictions on who can petition for relatives, restrictions on naturalisation eligibility, perhaps even some kind of more overt racist policies (think Travel Ban but on a much larger and more colourful scale) if the orange one thinks he can get away with it, and he has enough enablers around him left to enact it.

So right now America is kinda at a crossroads, and the next year or so is going to set the tone for the foreseeable future.

But as I said above, in all likelihood you will be fine since Canada is almost the 51st state. Now if you were from Mozambique, India, Mexico... somewhere like that, you might run into more issues (or just wind up dead solely for being an immigrant) because that is what, collectively, a large chunk of America sees as acceptable right now. Just keep an eye on the news, stand up for yourself and know your rights (just because you're only an LPR doesn't mean these go out the window), and hope that things begin to turn in a more positive direction. These past few months I've felt like the wind has begun to change for us, that the blowback against this administration has begun. Let's see if it holds up.

One other piece of advice I would offer, as I have seen it come back to bite people.

Have your fiancee apply for a social security card a couple of weeks after she arrives.  She will need it for so many things, and she will be denied if she applies after her I-94 has expired or has only 2 weeks left before it expires.

If you can't get a joint sponsor, and given that you can't change the past, I would suggest the following:
Include a letter stating that you were not required to file a tax return for 2015 and 2016 because your income was $0.00  Provide a letter from your current employer on company stationary stating your current annual salary, your job title, and how long you have been employed with the company  Include at least 2 months of pay stubs, 6 months if you can Good luck!

I see nothing wrong with the OP's attitude.  She (assuming not a same sex couple) asked a reasonable question that any logical person might ask.  I did not interpret her question as trying to do anything other than gather information in order to make an informed decision.

OP, I would recommend (as others have) that you file AOS now and bring your updated information to your interview.  There is a  small risk that, with the new policy, your application would be denied, but since you are at the 125% level, I can't see USCIS denying your application without issuing an RFE asking you for a sponsor.  That policy change was intended to eliminate those who file "placeholder" applications with very little evidence up front--typically businesses filing for immigrant employees.

    Good luck!!

I am not a tax expert, but I do believe that a non-USC spouse's income is subject to U.S. taxes no matter where you are living.  I am pretty sure you are required to report all income for the year, even if you marry on December 31st.  There are deductions for taxes paid in other jurisdictions, so you shouldn't be taxed twice on the income.  I would definitely recommend that you consult with a tax attorney or CPA who has experience in filing taxes for a "multinational" couple.  The IRS code is complicated enough for a USC married couple--let alone for a couple where one spouse is not a USC and has lived and worked abroad for a portion of the tax year.

ddtenor2 got a reaction from Dutchster in Social Security Number requested while on I94 never arrived - can I send AOS?
My husband checked the box on form DS-230 requesting that an SSN be assigned for him.  When he arrived in the U.S. we went to the Social Security office to inquire about his card, and the customer service rep said that you can't always be guaranteed it will be assigned.  (Turns out it never was.)  He also said that if you applied for an SSN on your own while one was being assigned, you could end up with 2 SSNs which presents problems of its own.

We were married in NJ, and the wedding license application also said that an SSN is required, but when we went to apply, the clerk said it was not required for immigrants who did not have one.

I would strongly recommend that you mail your AOS paperwork and, if you haven't received your Social Security card by the time you get your EAD, go back to the Social Security office with your EAD to get issue sorted out.

My husband and I got married at the courthouse with only my sister and brother-in-law in attendance.  We even AOS-ed without an interview.   As @Alabamak1 noted, the important thing is the commingling of finances.  Have your fiance get a ssn as soon as possible after arrival and add him/her to your bank/credit card accounts.

Assuming you paid for the ticket with a credit card, if the airline refuses to issue a refund when you cancel the return flight, you could dispute the purchase with your credit card company.  I don't know whether your credit card company would  issue you a refund, but you have nothing to lose by trying.

If you will still be living in India at the time of your filing, you might want to research a Direct Consular Filing.  I believe that is an option at the embassy in New Delhi.  If you're able to do it, it will take a matter of months for your wife to receive her visa rather than the current wait time of 12-14 months.

    Technically, this is true.

Note, though, that the entire packet sent to USCIS is forwarded to the embassy/consulate before the interview, so the CO will have the chat logs/Skype messages in front of him/her at the time of the interview.  Every consulate is different.  Amazingly, based on reports from other VJers, some COs in high-fraud countries will not ask for, nor will they accept, documentation from the beneficiary at the time of the interview.  Fortunately, Brazil is not a high-fraud country, and the interview in Rio was pretty painless.

OP, I don't think you will have a problem if your name appears on the chat logs.

    Good luck in your journey!
