Something very strange is going on at the USCIS...

My wife came here on a K1 visa at the beginning of 2020. We got married, she applied for and received her conditional green card, then applied for removing conditions and got her 10 year green card. She has been eligible to apply for citizenship for a while.

 

She has applied twice and the n400 was rejected twice for invalid reasons:

 

1. First n400 filing. One of the pages was "missing." It was NOT missing. The entries on the "missing" page were merely handwritten in black ink, and fully legible. We also provided our federal and state tax returns for the reduced fee, and we definitely made <400% of the federal hhs poverty level for our family size in 2024. However, they claimed we provided the wrong fee.

 

2. Second n400 filing. We were told we used an outdated version of the form which is why it was rejected. I checked today online and our returned form, it's indeed the current version of the form! I did file the prior papers with the same dates, just with the previously "missing page" printed from a computer rather than handwritten.

 

So what the #### is going on at the USCIS? Are they hiring incompetent workers now? Are they just trying to prevent people from becoming US citizens?

Yes, not new.

Not really. I can bet money if you file online today and pay the full fee, it will sail through.

The difficulties begin with reduced fees, waivers, things filed not ideally etc which make case a tiny bit more complex than simple. Essentially, even slight imperfection can cause rejection.

 

You should have completed brand new form (make sure it's current). Don't mix typed text and handwriting. Write a cover letter explaining why you qualify for reduced fee.

the number signs indicates site censor replaced the profane word with number sign.  cease attempting to use any profanity on this site.

1 - assume it might be confusing to have part of the form filled out by hand when the rest is done electronically? Curious too what you had to fill out manually tbh.

 

2 - sounds like an error on their part which unfortunately can happen... 

 

If you decide to attempt to file again for reduced fee I'd perhaps suggest adding a short cover letter on top to make it abundantly clear that you are applying for the reduced fee as well as what type of evidence you are attaching to support this and where it can be easily accessed in the stack of papers. I'm assuming lockbox employees will need to check you are indeed below the required threshold before formally accepting your submission.

One option, if you can,  is to pay the full online fee and file online.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
