When to ACTUALLY begin removing conditions for Citizenship

Hello All,

 

My husband and I married October 18, 2020. He received his 2 year conditional green card in May 2022 (long delays, then RFE, then approval). When can we apply for citizenship? I'm hearing its a 3 year wait time from time green card was "issued". Just need help managing my timeline on what to do and when. Thank you!

There's two forms to file:

I-751 at 2 year minus 90 days anniversary of getting conditional GC

N-400 at 3 year minus 90 days anniversary of getting conditional GC

Removing conditions and citizenship are two separate processes.   VJ has guides for them.

citizenship can be applied in Feb 2025 and after  provided he is still married and living with the spouse at that time

Not a lot more to add, but wanted to expand a little on what @Boiler mentioned.  When your spouse's 90 day window opens to file for N400 and assuming they plan to file that online, wait at least 1-2 days (a week is probably better) to submit to avoid any weird headaches that could come from USCIS's system (see attached thread).

 

Also, as others have said, the I751 is a separate process and will be necessary to file two years after the GC issue date less 90 days, so don't conflate that with the N400.  There is a lot of debate if it is good to file the N400 while the I751 is pending.  I am on the side of if naturalization is the ultimate goal, there is no reason to wait for the I751 to be finished to file the N400, but I do understand there may be some nuance related to processing times for the N400 at the local office.  You list San Bernadino as the local office which is currently showing 9 months for the N400, and with the I751 taking up to four years now, I see no downside.

Did you file for 751 Removal of Conditions? You NEED to file that first prior to N400. Your timeline doesn't say if/when you filed it.

They just got the 2 year green card a year ago - May 2022. It's not time for them to remove conditions.

You should be eligible to file for citizenship about a year after filing the I-751 to remove conditions on residency.  You cannot skip the I-751.

I don’t think she was aware of the requirement to ROC prior to naturalizing.
