If I move to Mexico to live with my wife after I have applied and submitted my sponsorship income stuff, will I later be disqualified if I have no income for the time living in Mexico? I have plenty to live off of for a while and my line of work would allow me to get another job almost immediately upon reentry.

At the time of your wife's interview, you would not qualify to sponsor her.  The I-864 requires that the sponsor have sufficient current income/assets.  Options --

  1. Return to the US and get a US-based job prior to your wife's interview, or
  2. Stay in Mexico with your wife and submit a new I-864 using assets only to qualify, or
  3. Get a qualified joint sponsor residing in the US and submit the I-864 from the joint sponsor.

That is how I see it, too.

Exactly.  Otherwise you are gambling that she doesn't get asked that question.  You must qualify on the day of the interview.  Whether that question will be asked is anybody's guess, but it's a common question.  Sometimes they ask just to see if the spouse knows the answer, but if the answer disqualifies you, there will be a delay in visa issue.

Ok thank you all for your thoughts. That’s kind of what I was afraid of. How much more would it complicate the process if we apply now but then both move to Canada where we can obtain a work visa and live together until the us visa is ready?

Canada is tougher on domicile than Mexico.

Your plan won’t work.

The only way the Canada plan would work, is if you have enough liquid assets to qualify as sponsor using assets alone.  Canadian income won't help you qualify.  Then of course, actually both getting employment visa for Canada is a real long shot to begin with.

Are you saying that because I’m earning non usa income it won’t count as income?

That is a true statement.  Only income which continues after the new immigrant and petitioner re-locate back to the US can be used as qualifying income.

Yes.  Now would be a great time to become an A-Student of both the I-864 and its instructions.

Hey cc, I think you commented on a previous thread of mine that moving to a border town is the only realistic possibility of being closer.  We got married in last week. If we are going to file for the cr1 but potentially move how would that affect our process if at all?

plus very expensive to become a permanent resident of Canada needing a Canadian sponsor

My step daughter went thru the process when married a Canadian she met while working on cruise ship

How do you plan to move to Canada?  Do you have sponsorship?  Canada, just like the US, requires a visa if you plan to immigrate there.
