Then send in a reply with the RFE stating the beneficiary is not and never has been in the United States per the filed petition and send in a copy of the petition with your answer.  Advise there is no arrival / departure information for this beneficiary.  Advise that the I485 was filed in error per request and that the beneficiary will not be adjusting status.

So did we messed up and should’ve just filled i-824?

Leaving it blank was a very costly mistake. USCIS didn’t know where to send it so they just assumed. Withdraw I-485, file and pay the fee for I-824. Expect a long delay in the process.

Yep, they just assumed because you left it blank. Withdraw i485, file I-824, expect a long delay.

Yes you should have filed an I-824.  Send one in with the RFE reply and withdraw the I-485.  Costly mistake.  It happens.

Thank you all for the quick responses, i was able to talk to someone at USCIS yesterday, they informed me that yes we made a mistake for filling I-485 but when I was reading the NOA for the approved I-130, they will be refunding us the $1225, he also made us an appointment for Today  12/28/2022 at the USCIS office here so we can go ahead and submit I-824, my father in law filled out I-824 and faxed it to us, and finished it. Again thank you all

You were talking to a Tier 1. There's no refund you're getting. Go read USCIS website itself. 

 

And I believe you're supposed to be mailing that I-824. Field offices don't take applications. Again, you got wrong information from Tier 1. The letter you got tells you how to go about it. Follow it, just like you did with the I-485.

 

Well, since you got an appointment today, be sure to give us an update about your field office visit. Maybe there's some new USCIS policies we still aren't aware of.

FYI.. I-824 took us well over a year to get processed and probably another 3 months to have the file actually sent to NVC.

 

You will be waiting a long time.
