K1 Visa, Prison, Chance ?

Hello

I am new here, and hope I put my question in the right forum. 
I will try to keep it short.

 

I‘m from Germany, and my fiancé is an American citizen. Currently he is serving his 15 years in prison in Illinois. Next year in August he will be allowed to get out on parole. We have never met.
- He was convicted of: AGG DISCHARGE FIREARM/OCC VEH


As soon as he gets out, I fly to America with my  esta to finally see him.


Is there any chance we can get the K1 visa approved? Our families already know about our engagement. I am also in contact with his family.

Is it worth applying for the visa now? Or should we wait until he is released?

Exactly, what does this mean?

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

First of all, he cannot submit the I129F petition yet since you have not met in person in the past two years, but after you meet, then he can submit the petition.  As far as his legal issues, I am only aware of convictions related to the Adam Walsh act causing issues with the petitioner, but you may want to consult a lawyer.

I assume "Aggravated discharge of a firearm at an occupied vehicle" but I could be wrong.

Aggravated discharge of a firearm into an occupied vehicle. It was probably attempted murder and he plead down to this. He was shooting at someone in a car. 

 

OP, either way, in order for a K1 to be filed, you must have met in person within 2 years prior to submitting the application, so you'll have to wait until then.

i hope u are able to spend "Quality"  time in the US to really get to know this person and his family and who he associates with 

 

and don't rush to make the commitment 

 

u know he is in prison now/  have u considered asking for a criminal report to see his entire history and know what u may be getting into?

one woman was engaged to a man who said he had spent time in local jail and when she came ,  she went to the local police department and found out he had a long criminal background

Hello

 

I do know y'all have to meet within 2 years and he also have to show that he can provide for you. To be honest give him time to get out and get yourself together like a job and a place for you guys and then get a lawyer because you the one playing on visiting and staying in the USA as long as you don't have a background and haven't been locked up I think you should be okay

One of our long-time regular members married a guy who had a felony record.  I'm trying to remember who it is.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I wish you luck on this journey. I would say as long as you don't get any felony charges don't get in any trouble you should be fine because you are the one who are entering the United States good luck and I wish you the best don't give up remember have patience be humble but don't give up
