Seeking thoughts,

Controversial topic

Would like to apply for a visitor visa for my spouse overseas. We are currently in the I 1-130 process. Few say it's ok to apply and others no. Due to the assumption the invited guest will not return back. The thoughts from USCIS commonly here once you do your I 1-130

Unless she already has a tourist visa, highly unlikely they’ll issue her one.

Hi,

I have one more year on my visa to travel overseas. This would be a new application for my spouse to come here to the US on a 2b visa, visitor.

He can certainly apply

If your spouse would already have a visa it would be possible to visit you but getting a B1/2 when there's already immigrant intent established is not so likely.

Nothing to loose but the fee though.

the spouse would apply not the USC

and has to prove strong strong ties to Nigeria to make them return

with a USC spouse the ties would seem to show staying in US is more beneficial than returning to home country

strong ties:

job

attending school

own a home

Common question, not controversial. Often not successful in applying for a new B visa. May be moot anyway as - assuming your profile flag or Nigeria is correct - the current wait time for a B visa appointment in Lagos is 824 days and Abuja is taking emergency appointments only.

I would take 824 days with a grain of salt, also, I suggest you do your best to do the I-130 correctly to avoid unnecessary delays. I opted against the tourist visa for same reason as above, and I don't know if I can imagine the feeling of my wife having to leave because her visa not being out with 6 month max reached. Others do it, but overstaying or misrepresenting trip intent automatically bring a ban from 3-5 years. I recommend applying for K-3 petition as that helps the CR-1 go faster.

Please can you throw more light on how the K-3 helps Cr1 go faster?
