It really doesn’t matter that many others have done it themselves if you know yourself you lack those traits. There’s a reason we have lawyers, plumbers, electricians, carpet installers, auto mechanics etc while some people are able to do such tasks themselves.

PS: If you make a million dollars a year 😊, it just might not be worth your time in dollar terms to spend hours on the application.

You make a good point. Some people would be better off with a lawyer depending not just on the case itself but on the individual.

understand also that we have seen many posts where the lawyer messed up  

the applicant has to provide all the documents / they actually do the work

the lawyer fills out the application ,  USC needs to read and sign it making sure all is correct plus know the documents needed and make sure the lawyer sends all (sometimes they haven't)

knowing why denied is important and the CO would have indicated this at the interview

as for a letter of denial / still waiting since 2009 for mine / they don't always send one

some embassies indicate on the 221 g the reason for denial/  some don't  -it can just say not eligible for a  visa at this time

 

Marriage is the best route to go now but clear up any issues

Sounds like it, the I129F petition, was denied in the initial USCIS stage, but still waiting on a reason.  I agree with you on the lawyer comments.  Even if one decides to use a lawyer, they need to be very diligent in reviewing what will be submitted in their name.

The first comment explained it very well for you or whoever this is for. Please understand that lawyers do not guarantee approval or eliminates any application mistakes. Lawyers mess up just like anyone else could. 

 

VJ members typically only recommend lawyers if there are any barriers that prevent the issuance of a visa. 

 

The applicant needs to find out first why the USCIS denied the application in the early stages of the process. Once that is clear, you can come back here and let us know and we can help you how to go from there.

Thank you so much guys for taking time to answer my inquiry here. So, this is the back story of the case. This case is not mine. we are helping a friend with his petition for I-129F or fiance visa

 

He went to meet his Girlfriend in Philippines Nov. of 2018. Filed divorce 2019 from previous marriage. He filed I-129f Nov. 2020. 

January 2021 his I-129f  Packet was returned to him. The notice says he fails to put his signature on the Petitioner's declaration signature. He then again send the I-129f packet back to USCIS the next day with his signature. March 2021 he received a notice of receipt telling him that they received his case. July 2021 he received an RFE. he fails to check or answer the question (have you ever been arrested). he answered it and mailed it back to the uscis. he said he noticed that he send the photocopy instead of the original RFE that the uscis sent him. i dont know how many days had passed when he realize it. but he did send the original RFE to the USCIS right away. yesterday, he check his case online and it showed case is denied. now he is thinking of hiring a lawyer for this case. 

 

 i saw some red flags along way.

1st- he fails to put his signature

2nd- he fails to send the original rfe.

 

in this case he needs to go back to the Philippines because the 2years of meeting is already passed due. 

we still dont know the reason for the denial until he receives the notice. 

we told him to visit visajourney because this site ready help you find answers. 

i dont know if he ever visit this site. we just want to help him.

I think it might be the 2 year rule as he filed in November 2 years (approximately) after meeting.  Specific dates are needed as if he filed even one day after the 2 year anniversary of their in-person meeting it would be denied.  Considering the packet was returned to him since he did not sign it, that probably (not sure myself) reset the filing clock so January 2021 and then again in March 2021.  Anyway, let us know for certain when you find out and try your best to convince him to start an account here.

Exactly. that maybe it the 2year rule. we actually advice him to file earlier but he has his reasons. 

i will definitely let you know when i found out the reason.

Even more complicated.  The OP is asking for a friend that is also filing for a K1, but it was denied.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes very careless. I actually told him to make an account here so he can seek help in this site. But anyways, I will let you know when I found out the reason for the denial.

It sounds like they filed an incomplete I129F right around the 2 year anniversary of the in-person meeting, then sent it in after that period.
