I hope that I put this at the right place .If not excuse me I am a new member. 

I am conditional Green card holder ( adjusted my status from B2) and today I have scheduled my written driving test at the local DMW office. 

The gentleman who worked there, told me that I can't do that test because my I 94 is expired ( of course it is ,I have come here with B2) .Despite the fact that I have shown him my valid passport, State ID , Social security, and Green card .

He even called someone and they told him that I am not eligible for that test 

I am shocked and confused. Does it mean that us who have adjusted from B2 have not legal right to drive?

I agree that he is absolutely wrong.  Go to another DMV office.  It should be pretty easy to find that an I-551 (green card) is sufficient.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think so , no logic in showing I94 if I already have a Green card but he told me to bring it so I did.

This is what will do must find the nearest one, not so easy in my State ,but well .Don't want to deal with this man anymore.

To be fair, the list of required Proof of Authorized Presence examples are a little confusing, but this person made a mistake as both places (not sure why MT decided it needed to be listed twice) that reference the I94 and I551 show either or.  I have never heard of an expired certificate of naturalization.  :)

 

A valid, unexpired passport issued by a jurisdiction other than the U.S. with:

  • an attached U.S. Citizenship and Immigration Services (USCIS) record of arrival and departure (form I-94) (same name with an unexpired endorsement of the nonimmigrant status)
    OR
  • an unexpired permanent resident I-551 stamp

 A valid, unexpired passport issued by a jurisdiction other than the U.S. and either:

  • an attached U.S. Citizenship and Immigration Services (USCIS) record of arrival and departure, form I-94 (same name with an unexpired endorsement of the nonimmigrant status) or
  • an unexpired resident permanent resident I-551 stamp

Yes I have read that and called them before I have come there. Well I will try another DMW as good people here have told me.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

The officer is super wrong. If you already have greencard, u can get Driving license. I don’t even have GC and I can get one because I have EAD and SS

  1. Well, just go back and talk to someone else. Go with printed requirement from website stating what is needed. Someone may be new or just ignorant.
  2. Or go somewhere else. But still, have the printout with you

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

The guy is wrong.

 

You have a green card.  The fact that you adjusted from a B2 is nether relevant nor any of his business.

I'm from the UK, hubby is from Michigan and is a retired US Army LTC.   We are currently stationed overseas.

Here is our immigration journey so far....

10.26.13 - Our wedding in Scotland 

11.26.14 - Filed I-130 at US Consulate, Frankfurt (DCF)

11.18.14 - Returned to Scotland to renew our vows for our first wedding anniversary

01.08.15 - NOA2 received in snail mail, together with case number and Packet 3 instructions

02.15.15 - Submitted Packet 3

02.17.15 - Packet 4 received by email with instructions to schedule medical and interview

02.18.15 - Email authorisation received from Consulate to gain access to appointment calendar

03.03.15 - Medical

03.18.15 - Interview - Approved

03.21.15 - Visa in hand

06.10.15 - POE Chicago (final destination Detroit)

07.20.15 - Received SSN in mail

07.27.15 - Received 2 year green card in mail

The journey to ROC starts here...!

10.05.15 - Returned to Germany on government orders

05.25.17 - Mailed ROC package to California Service Centre

06.14.17 - Received NOA 1 (dated 05.30.17) in mail

09.05.18 - Received a second NOA (dated 08.11.18) in mail granting a further six months extension to green card due to 'processing delays'

11.26.18 - ROC - Approved

12.05.18 - Approval Notice I-797 received in mail

12.18.18 - 10 year green card received in mail
