Selective Services - Worried Mom

Timeline

My son just turned 26 years old and will soon file for the N400. While I am filling up the N400 form for myself, i read about “registering for selective services”. Has anybody encountered any problem applying for the US citizenship without registering for the selective services?

How old was your son when he immigrated to the US?  Did he apply for AOS?  If he applied for AOS, he might already have registered with selective service.  

Your son can verify to see if he has already registered with selective service. https://www.sss.gov/verify/

He came here in Guam when he was almost 21 years old. We just checked the website and sure enough he’s not registered.

Your son may want to wait until he turns 31 to apply for US citizenship.

 

When he got his green card, he also received information that he was required to register with selective service.  Hard to claim ignorance of the requirement when he was given the information.

Yup. The "Guide for New Immigrants (M-617)" that USCIS sends with the GC lists the SSS requirement very clearly in the Responsibilities section. DOS also provides Form DS-1810, "Notice of Duty to Register with US Selective Service System." And Guam also asks if male DL/ID applicants want to register with SSS: https://www.sss.gov/register/state-commonwealth-legislation/

Hi, I asked my son if he did choose the consent to register with SSS when he was applying for his driver’s license here in Guam.. he said Yes and he thought he will be automatically registered. I asked him to call the selective services tomorrow to check.

Normally adult male immigrants under age 26 are automatically registered. I know the I-485 form has stated that for some time now and it would have when your son was age 21.  
 

i don’t know about a DS-260 though.  
 

How did your son immigrate: I-485 or DS-260?

K2 visa. We did i-485 after.

Then the failure to register with selective service was on the part of USCIS and not your son.  
 

Also when you checked online, you would have used his SSN.  He likely would not have had an SSN when he adjusted status. So he might have been registered.  
 

Thus I would file the N-400 now versus waiting until age 31, and state that per the I-485, he assumed he was registered automatically.

Witha K the very first thing you get is a SSN.

 

It  is his responsibility to ensure he registered.

The very first thing some K visa holders including my wife  do  is get an SSN.  As we have noticed on the web site, some don’t. Some come to VJ after the mistake instead of before the mistake.  
 

So I don’t presume OP’s son had an SSN and even if he did, I don’t presume USCIS utilized that SSN even if this SSN was provided in the I-485. 
 

I am also getting weary of the incompetence of various agencies like USCIS, USPS, and State when it comes to handling immigration.  OP’s son paid substantial fees to USCIS.  The I-485 doesn’t say USCIS might handle the selective service registration it says it “will” register the beneficiary. Words have meaning. 
 

So I stand by my advice.  There was no willful attempt to evade the military draft. In fact substantial money was paid to the US government to register and the US government apparently failed as it often does.  This is a breach of contract.
