Married during K1 visa administrative processing

Hello everyone,

 

I have applied a K1 visa for my fiancé overseas and he had his interview December 2018. They placed him under AP and last updated the status with a refusal a year after. Today, the embassy sent us an email apologizing for the late reply and requested new medical exam and police record since it’s been way over time. However, my issue is that we got married overseas after receiving our refusal on CEAS last year. I am confused on what I should do now that we’re married. Do I proceed with requested forms or do I state that we’re married and cancel the visa. We were so desperate to get married and waited for a decision for so long and once we got the denial a year later we decided to marry. Can someone please help?

There is no way you can continue with the K1 because you are married now, since you married you should have sent an email to the embassy to withdraw the K1 and apply for CR1 right away if you could, now you need to cancel the K1 and start with CR1 anyways.

You cannot continue with the K-1.  Do not submit a new medical and police certificate.  I would contact the consulate to cancel/withdraw the K-1 application.  Has the spousal visa process been started?

You need to start the CR-1 process. Likely it will take around 18 months, depending on how long he spends in AP this time.

Sounds like you got confused by the refused, basically what the system shows when it has not be approved.

 

Also sounds like you have not filed anything now you are married?

The moment you married the K1 became a non-option.  You needed to file for a spousal visa.   Write the consulate back and request to withdraw the K1.

Hello! Hope you’re doing fine.

You must communicate the Embassy that you ended up getting married overseas, withdraw your K1 Visa petition and file a CR1 petition. 

Due to the pandemic, it may take you a little more time to get responses from them, however, you must contact them (with your K1 Visa case number and full names of the petitioner and beneficiary) as soon as possible.

For the benefit of others that may read this thread. A refused status in CEAC does not necessarily mean that the VISA has been denied.
