Visa K1 now (October) or Wait?

Because of the pandemic, the Rio Consulate is still closed for routine visa processing, and as cases rise in Brazil it doesn't look like it will reopen anytime soon.  USCIS is still processing petitions, so definitely have your boyfriend submit the I-129F petition as soon as he can, or as others have said, he can go visit you in Brazil and get married (that's what we did, because of the big advantages of the CR-1 over the K-1 visa), then file an I-130 petition for you, which can be done online now which speeds up the process a little bit.  By the time either petition is approved, from 5 to 10 months, hopefully the Rio Consulate will be open again so they can start on the visa interview backlog, which is huge and will take months to catch up.  So you may have a year or longer before getting a visa, and that is if everything goes well.  It could take two years depending on the Rio Consulate reopening date and the backlog.  Nothing is fast with US immigration, even pre-COVID it was slow, so just accept the fact that it will take a long time to "get into the USA."  Good luck!

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Definitely the Cr-1 would be the best option, I will talk to my fiance about it, because we need to be ready to get married.

Yup. Especially since the Brazil proclamation is in effect indefinitely until the President ends it and K-1 is affected by it.

So during COVID times it does add an extra layer of difficulty to travel and get married. You will have to go somewhere both of you can travel to and try to find somewhere that produces a fast marriage certificate. Flights are limited and expensive. You will also need to research COVID testing policies in the country you decide on. And make sure to research all the marriage requirements needed as well.  

Found love, thought I wanted this path, two years later realized my partner was not worth all the stress 😁

CR1 currently also has extra benefit for Brazil as spouse of usc exempts you from the Covid-related  travel ban, just being a fiancée does not.

Yes this is good, but I believe that for that I should have a valid visa

My fiance and I didn't think about this possibility before, but we will talk, he can come to Brazil, I believe it would not be in his plans, that's why k1 is still our first plan

Only you and your fiance can decide which is better for you.  However, many people who went the K-1 route regretted it later....usually due to the "limbo period" of not being able to work or travel outside the US for many months......and the K-1 route is more expensive..... Life is full of decisions...and consequences.  Good Luck.

Yes. The CR1 will be that visa. The K1 will also be a visa, but will not circumvent the Covid ban. Of course the ban could be over by the time you get the visa anyway...but who knows.

The USC is the one who would submit the petition.  The petition is about the USC petitioner.

 

Not sure what you mean by 'not even the biometrics they are taking'?
