I just received an email from USCIS your case status: Post Decision Activity does it mean it ship to NVC?

Post decision activity will include all the actions that the USCIS takes after denying or approving your petition. If your petition is approved, USCIS will send a notification to the US Department of State or the National Visa Center, and this is known as a post-decision activity. If you have a compelling case with reasonable supporting documentation for your application, then I believe that you are moving on to NVC.

If your petition is denied by the USCIS, which in your case, I doubt, you can appeal the denial of your petition, and if your request is considered, USCIS will reconsider your case. All these activities are regarded as post-decision activities. Post decision activities involve several steps, and you may check the levels online by making use of your case number. Hence, the post-decision activity includes the actions that the USCIS takes after adjudicating a petition.

You are probably closer to getting the K1 done then marrying, getting a new petition together and doing DCF.   You can probably apply based on exceptional circumstances.  All off the consulates are closed and they would need to process, with USCIS permission, the petition.  You and your spouse would need to have residency at the consulate you fill at.

Hopefully the attorney got you expedited at the NVC so you should be able to process ASAP when the consulates reopen.  The EO does not apply to K1.

Make sure that you or your attorney contact the NVC once they get the file and get it expedited.  Even with the consulates closed they have expedited processing to get some priority cases thru and visas issued.

Do you have a case number from NVC? If you have a case number, then the first thing you need to do is go to ceac.state.gov and under immigrant enter your case number. That will tell you the status of your file. We need to systematically follow the case file, then we can tell you what to do next.

There is a chance that you can get through to the embassy, but it may be better to send an email. Be sure the subject shows high importance so that it gets their attention and not "where is my" question which would be ignored until such time that they feel the need to respond.

This is an elephant and we can only eat an elephant one bite at a time. Let me know the outcome of both activities; your ceac status and the email response. We can do this!

As a vertarn I understand the need for medical. I use the VA and they have litterly saved my life. Currently they are maintaining it at a much higher level since my cancer dianositic last year. Good luck my friend and thanks for your service and sacrifice.

Hi Greenbaum, I haven't received the number at NVC yet, but it has been sent by USCIS so hopefully once I get it I will let you knot thank you

Use the NVC call number and keep checking to see if your case is there and a case number has been assigned. Once we get that we can get this bad boy moving.

Do you have the USCIS helpline for military?

USCIS has established a toll-free military help line exclusively for members of the military and their families. USCIS customer service specialists are available to answer calls Monday through Friday from 8 a.m. until 4:30 p.m. (CST), excluding federal holidays. After-hours callers receive an email address that they can use to contact USCIS for assistance.
