90 day rule question

Hello, 

 

I met my wife while she was on F1 visa, we married after 2 years in November, but she had to travel back to obtain her birth certificate. We want to file for change of status, but couldn't without the birth certificate. 1. Does the 90 day rule apply in this instance? Or can we start applying for it? 2. If her F1 visa expires while waiting for the change of status to be approved, can she stay in the United States?

She can stay in the US but she can not leave until AP or GC arrives

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Did your wife go to her home country to obtain her birth certificate for I-485 and come back to the US on F-1? If so, she cannot do AOS (although the USCIS might not be able to prove that she had "immigrant intent" at the POE). It doesn't matter how long she has been in the US after re-entry.

Then how do other people get married during F1 visa?

Timeline

Now that your wife is already here, just go and file for it. She has already been legally admitted by the CBP. Don’t worry about other stuffs. FYI, it’s adjustment of status not change of status, using the correct terminology helps getting better responses.

You are not permitted to file AOS if she went home to get her birth certificate so that y’all could file AOS.

 

thats classified as visa fraud, your not permitted to enter on a non immigration visa with intent to adjust
