I agree. It’s a very sloppy form. And the fact that they even ask if you have insurance purchased for when you arrive in the us makes no sense.m since you can’t even purchase it until you’re here! They didn’t research at all when making this form I feel like

  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

My point exactly!!! Some questions don't make any sense, especially Part 4 where it asks to list the tax returns filed for the last 3 years......HOW IN THE WORLD is an beneficiary supposed to file 3 years of taxes when they're not even in the US????? They obviously rushed this form just to get it passed quickly.

Yes, I agree with everyone how sloppy this form is. But, If you see the form itself section#9 is actual nested under part#4. (PART#4, SECTION#9) and PART#4 reads "YOUR ASSETS RESOURCES and Financial status"

 

I had to re-read the form a couple of times and re-write this section. My final action was not to add anything belonged to the petitioner. From my understanding this form is directed to the beneficiary. Hope this helps and if someone has another explanation please share with the group.

I think they made a generic form that can apply to immigrants that are coming here for the first time and also for people that are adjusting their status that are already here as well as people that were here temporarily and left and are coming back  or something, who knows? But I think they could have had an instruction page to explain the form better to clear any misunderstandings and confusion before releasing the damn thing. SMH

I think so. My consulate told us it is now required at consular level and NVC

Could you please tell me what documents you attached with the 864. Am I missing something?

 

12 months pay stubs (no W2 bc I live abroad)

3 years of tax transcripts

Bank letter stating savings amount for assets

Proof of domicile in US (apartment deed)

I tried to apply on there a couple days ago but of course since he is not a resident yet he was not eligible; but will be once he arrives. The customer service rep suggested he use that to show proof he has tried to apply for insurance. Didn’t even think of that! I got the letter of eligibility when I went on healthcare.gov and made an account and attempted to apply for insurance for him, they calculate your eligibility and then you get a PDF staring your eligibility results notice, my husband's says "would be eligible, but we need more information from you. Please include documents for immigration status" and lists things such as I94, I551, or visa number, etc which of course we don't have any of those so that can be shown to the consulate to show that we tried but that we require actual immigration status before he can get it! But we are also still researching options to attempt to get him insurance before the interview, right now looking into a temporary insurance plan (6 months long) but not really sure yet if you have to show immigrant status to get it. Though I think the eligibility letter is definitely a good start. It even lists an application date and an application number to show that you actually did fill out an application

Yes, it is directed at the beneficiary, but I'd take this to mean YOUR RESOURCES as well. What is available to you - the beneficiary. In the case of our IR1 visa, my spouse would have the resources of my HSA for example. My spouse is not the owner of the HSA, it's just available to her.

Yes, I agree 100% with you... Did you add your resources under this field? I didnt.

I will be yes... Interestingly, if you add anything to the asset or debt section, you can't later removed that field and make blank again. I had to start again. I just don't know what they mean by 'location of asset' the bank name, country? um....

We got a hospital bill from when my husband was here so we will unfortunately have to put down a debt 😬 But, we have way more savings than the debt is and my husband already has a job offer for when he gets here so I hope we should be good
