Timeline

we received the following from our congressman from US embassy casablanca Morocco we are very upset because we were not informed about this on the day of interview, also we tried to email many times no reply, here is what our congressman received 

 

Dear xxxxxxx

 

Pursuant to a request for status sent on your behalf to the U.S. Consulate in Casa Blanca Morocco, I have received the enclosed response from that agency stating: 

 

The case was reviewed by the consular section chief and the interviewing officer.  At time of interview it was determined that Ms. xxxxxxx xxxxxxx did not have domicile in the United States, as she has been a permanent resident of Morocco for the last five years.  As a result, Mr. xxxxxxxxxxx case was placed in administrative processing until the petitioner re-establishes domicile in the United States.

 

Your constituent and the beneficiary are welcome to provide evidence of this to the Consulate in order to continue process their case.

 

proof of domicile we provided statement residency signed and natorized by my wifes mom that my wife is currently living there and temporary living with me and that  we would move there when application is approved but we did not provide letter from my wife intent to establish domicile in the US, my wife is currently living with me temporary, can anyone send me example of letter intent to establish domicile for my wife ?? also my mother in law will write another letter of residency for my wife cause her mom is the owner of the house, and will send it to us here, thank you for your reply....

I think they are telling you that someone who has been a resident of Morocco for five years is not a "temporary resident," and that she needs to return to the US to establish domicile.  It is more than just having mom's address and a letter from mom.

 i heard  letter intent to establish domicile is enough and mom natorized letter plus my wife she just renewed her drive lisence on same address, and have vote card same address, plus she receive letters there too do not you think not enough ? my wife been here 4 years not 5.....

The letters from your mother in law or letters or intent are completely useless. 

 

Your wife probably needs to go back to the US and establish residency there. Find a job, bank accounts, etc.

The Consulate was not satisfied with her intent to establish domicile..........The best remedy, imo,  now is for your wife to move to the US, establish an address with evidence, and submit that evidence.......

 

BTW, a notary only verified her mother's signature......nothing else.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I'm not sure what you think a notarized document is, but it doesn't confirm the content, just the signature.

 

Your wife has not established domicile in the US because she clearly doesn't live there, and that is why you are not eligible for the visa.

we just do not want to separate with each other, but i see we have no choise for her to go to get this evidence.. thank you

Yeah, there are less than a handful of people who don't separate, and those people usually own a home in the US and work remotely.

thank you we will buy the flight soon, can you tell me what evidences she need to get when she arrive ? open bank account, bills so on.... right ??

She should just pretty much start a life there again. Getting a job, paying utility bills, rent a house or apartment, open bank account, etc..

So not just try to create evidence but start living there again and the evidence will happen. You seem to be looking at it the other way round.

She will need to show evidence of residency in the US, enough to convince the officers in Casablanca that she has established domicile in the US.  That may take a few months at least.  Even if she gets a job, opens a bank account, rents an apartment on the day she arrives in the US, they will want to see some longevity, a period of time that shows she is a US resident again. So plan on at least a few months of separation.  Most of us have been living apart from our spouses for a very long time during this process, at least a year, two years, some even longer.  She can visit you during the time apart or you can try to visit her.  Skype or Facetime becomes a very helpful way to stay connected.  Good luck!

utility bills in her name

tax returns showing she works here for a US company

a deed or rental agreement from a residency here in the US

it is clearly stated a US residency is needed for immigration so she needs to establish one

 

your wife needs to check her email (look in all inbox including the junk mail)  as this notice would have been sent to her / congressman only gets the same info that was sent to you 

a paper you were given day of interview or thru email would have told you she needs US residency and exactly what to do to show she has established one
