5 months might seem quick to some considering she's just getting out of a marriage.

5 months might not seem quick to some considering the marriage only lasted 1 month, according to OP.

Right smh...how is 5 months quick

5 months IS quick...

Especially if it is after you committed to MARRYING someone.

Also, do people not do their own research or something?? The "lawyer" who said your friend could serve jail time is incorrect. However, that doesn't mean there won't be other consequences. Your friend is already on USCIS' radar with her previous K1 petition. They won't be kind to her second K1 petition and her new guy if she files for him in the near future.

Is the second guy from the same country as the first one?

Well, I wonder if the "husband" knows that he can only do adjustment of status through the K1 petitioner and they will forever be illegal in the US.

Exactly. When the husband finds out that the only way to adjust is with the same first spouse that petitioned him thru K1, he may have the "I regret" syndrome and begs to go back to her. Love works in mysterious ways.

I doubt she would be approved so quickly after another K1, but it is possible. Some of the other requirements are that they:

- Show proof of relationship

- Have met in person within 2 yrs of application

- that the petitioner show she or she+co-sponsor can support both of them AND her ex as long as he's in the US.

-Both must be legally free to marry

Or, he might be working construction for cash and not worried about status.

Seriously??? Have a serious conversation with your friend, jumping into another relationship with another foreigner (let me guess, from the same country as the husband nr1?) is asking for more problems. Not to mention USCIS will start to suspect she's part of the scam to bring people over to the US.

Not to mention - she NEEDS TO DIVORCE THE FIRST GUY FIRST.

She seriously want to do K1 again? She will face heavy scrutiny. Did she even meet that guy in person yet? That's the most important requirement.

Forget about K3, non-existing.

Tourist visa is for tourist, not for immigration purpose.

Yes we know that tourist visa is not for immigration purpose

Your friend's fiancé can enter the US with a tourist visa in order to marry your friend and then return to his country to initiate the CR-1 process. Check out thread below:

But I don't know the current success rate of getting a tourist visa from the DR consulate.
