Needing some info

Good afternoon everyone.

 

So here is a situation of a friend who did a k1 visa to only find out she was used to JUST enter usa... entry to usa was Dec they got married Feb and the "husband" left in March no adjustment of status was filed. She is seeing someone else now 5 months later what options does my friend have a k1, a k3 or visitor visa. As far as visitors visa how likely it is to get that type of visa in Dominican Republic & what all do they need????? As far as k1 or k3 how likely her doing a k1 will effect this case if she decides to do it again????

Why is she even thinking about a K1 5 months after she got abandoned by her husband? Is she even divorced yet?

First off you can forget about the K3 visa because it does not exist anymore, on paper it does but it is very rarely granted.

 

She may face some scrutiny for the next K1 visa but she has to bring a lot of evidence. Also she needs to inform immigration about him if she hasn't already.

She did call uscis twice to report the situation they told her twice that the case was closed. What happen to K3

It's obsolete. Not being used. They want people to do either K1 or CR1.

K3's are technically still on the books but last year only 15 of them were granted world wide last year. So it is either a K1 or a CR/IR1 visa now

The new boyfriend applying for a tourist visa needs to show compelling reasons to prove they will return to their home country.

First step is for your friend to legally divorce if that hasn't happened yet.

Expect some added scrutiny if she is filing a new K1 so soon after the first  K-1 filing, marriage & divorce.

Well, I wonder if the "husband" knows that he can only do adjustment of status through the K1 petitioner and they will forever be illegal in the US.

Seriously??? Have a serious conversation with your friend, jumping into another relationship with another foreigner (let me guess, from the same country as the husband nr1?) is asking for more problems. Not to mention USCIS will start to suspect she's part of the scam to bring people over to the US.

 

Not to mention - she NEEDS TO DIVORCE THE FIRST GUY FIRST.

She seriously want to do K1 again? She will face heavy scrutiny. Did she even meet that guy in person yet? That's the most important requirement.

 

Forget about K3, non-existing.

Tourist visa is for tourist, not for immigration purpose.

She gotten an annulment because they were only married a month is there any penalties she can face or denial

I don't mean to be judgemental, but I'm shocked how quickly people fall in love and they are ready to commit to marriage o.O Especially after having a bad experience with scam and divorce.
