My fiance was denied the K1 visa because he was asked 2 questions in which he replied he did not know the answer, It did  not get the visa because the consulate determined he was in in the relationship solely for immigration purposes, Now we are married and will do the CR1. Do i need a lawyer? why do i need to do to prove the marriage is real?

what we the questions and what country is your fiance in?

 

as far as proving a relationship, its much like the K1. travel documentation, receipts, photos, and ASAP, get financial and legal documents (insurance, wills, etc) co mingled.

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

~Moved to IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports as the OP is asking about CR-1 process now~

 

Like above, you need to overcome the original issue. Just marrying and filing for CR-1 isn't a guarantee of anything. You have to resolve whatever the original issue was. Most likely it wasn't even just about the questions but other things.

 

No lawyer is needed, but extra face time I'm sure would be helpful.

 

What country is the beneficiary from? This could help others give specific better answers.

Well, you dont necessarily need a lawyer. There is really a personal decision.....from what I have seen most people tend to apply on their on without any lawyer support but some people just are too scared, or not enough time or whatever reason so they do hire on.

 

From a perspective that you K1 was denied I dont think you need a lawyer for that, you can proceed to CR1.

 

Would you mind sharing what was the question? It is weird that he was denied, from my perspective if you are in a relationship and now a little bit about your wife and life in general, you should be good to go for the questions....it makes me wonder what the questions were like.

What were the questions that he was asked that he didn't know the answers to, and what country is this?

Well the answer should be pretty obvious. You need to know enough about your spouse so you can answer all questions. You need to show proofs of time spend together, on going communication, etc. 

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.

24.07.2017 - NoA1.

A lawyer cannot change the facts of a case, so I would suggest starting there. I don't know the facts of your case, but the CO determined that the relationship was not bona fide based on their assessment of those facts.

That means more visits, more time together, more communication, etc.

You must prove the marriage is real in accordance with the INA, so that people do not just marry to get a green card without being in a real relationship/marriage.

why do they need to know the marriage is real?

 

ummmm because those are the RULES. they want to know someone isnt using it just to move to the US, for any number of possible reasons.

 

 

what were the questions asked and where is your fiance from?

Chill out.  The question was not "why do they need to know the marriage is real?"  The question was "why do i need to do to prove the marriage is real?"  English is difficult.  Replace "why" with "what" and everything makes sense.  The OP is asking what does she need to do to prove her marriage is real for the petition.

The questions they ask at the k1 interview are very basic questions which is why it’s not surprising they thought it was an immigration purposes only relationship. If you don’t know basic information about your partner then it’s really hard to believe you’re in a real relationship and they were right to deny. However, you’re passed that stage now because you got married. You shouldn’t need a lawyer if you don’t have any criminal activity on your history, however it might be worth getting to know each other’s lives and basic details about each other because you will have another interview, with the same questions about your relationship and they will still evaluate you on how well you know each other. Specially on a denied k1 based on no bonafide relationship.

Thanks everyone for replying.. My fiance was asked two questions: 

1) what was my salary? He did not know the exact answer to that one.

2) how long I have been living in the US? this one, he knew I came to the country when I was very small.
