I don't know where you heard you cannot get a K1 visa. Yes, you can. The laws of the country do not matter. The consulate is on US soil and US laws apply. 

 

You don't need a lawyer. The process for same-sex couples is the same as for any couple.

Even an american can not just go live in Canada / and BTW it is expensive to fo thiis paperwork

if not married to an Canadian 

  1. Be at least 18 years old. ...
  2. Or enter the pool for skilled immigrants. ...
  3. Have a permanent residence in Canada. ...
  4. Declare your intent to reside. ...
  5. Spend six years at that residence. ...
  6. Provide your income tax filing. ...
  7. Speak English or French.

We are both like tourist only to Canada. only we have decided to have our marriage done in Canada since I will be visiting this year. and U.S citizen dont need visa to visit Canada..

I asked with a visa consultant here in Jeddah Saudi Arabia and the answer I get its like an insult. they told me that you are in an islamic country and how can you ask for fiance visa for same sex? I was thinking that since this country doesnt recognized same sex, then they are not issuing k1 VISA..

Saudi Arabia has nothing to do with the visa process, it's an American process and the interview will be held at the US embassy - where same sex marriage is perfectly fine. So marry in Canada if you want, but no reason to go through a visa process in Phi when you can do it in Saudi Arabia instead.

Sorry.. Should be July2018 next yr... I get a tourist visa for one yr thats why we are going to met in Canada and planing to get married there if possible.

 

I have read in some forums that getting married in canada doesnt require to be a permanent resident thats why I am thinking of this options..

You have to ask to consulate. Of course someone from Saudi Arabia is going to tell you that, they are not American and they behave according to the law of their country. 

 

I know on VJ people from worse countries than Saudi Arabia have received K1 as same-sex couples.

Many countries not just Canada, are considered marriage destinations (including the USA) and visitors are welcome to marry there as long as they can navigate the local rules and regulations

Thank you so much for your comments.. Yes, you have the point as well and my partner says that he might hire an immigration later if he starts to process our papers on how can i be moved to US legally.

You are right, but I would thread very lightly on this.

The applicant lives in a country (of which he is not a citizen and where he has limited civil rights) where homosexuality can be punished by death. He will only spend a few hours in the US Embassy. I totally understand his concerns about applying and getting a visa at the Saudi post.

Not to veer off the main topic, but where the heck is it worse for same-sex couples than Saudi Arabia? It's pretty much as anti-same sex couples as a place can be. 

 

Edited to add: My comment has nothing to with the difficulty of getting a visa to the USA, just a country's own laws/policies.
