curiously, how did she sustain herself for the past 5 years? i assumed that she do not have a SSN, considering that she do not even have a green card! No SSN, usually no one would employ you unless you are working at a store/bar etc where they pay cash . (well i am not that familiar with the way undocumented people earn a living in the USA anyway). 

 

But yeah, she was grossly misinformed and now she will have to pay the price - time and money...

Her timeline now is looking to be something like this:

 

File for the AOS, average about 8-12 months (or longer) before the interview.  Total cost is $1,140.

 

If she needs a new medical done, cost could range anywhere from $100 - $300 (or more since practitioners can charge what they please, if you need vaccinations, etc.)

 

If approved, she would receive her green card about 2 months or so after that.

 

She would skip the ROC only because of how long she's been living in the US and married to the same spouse.

 

File for the N400 three years (minus 90 days) after that.  Average about 6-12 months (or longer) before the interview.  Total cost NOW is $725.00 but may go up within the next 3 years.

 

If approved, she would take her oath ceremony (when she becomes an actual citizen) about 1 month or so after that.

 

She's looking at roughly close to another 5 years before becoming a citizen (if she gets approved for the AOS).

She should consult a lawyer before filing anything, to see if she has a possible Notice to Appear for overstaying. If she has an A number (I'm clueless on k1, do they get this when they get the k1?) she can call the EOIR 800# and check herself by inputting that.

 

My goodness, she is so soooooo lucky she didn't file for that n400, all she would have gotten is a notice to show up in immigration court and a long, expensive headache to terminate removal then AOS.

What are you talking about? There is no notice for overstaying unless she is caught like she would have been if she went and filed the N400. She just needs to file for AOS ASAP like tomorrow.

When you arrive on a K-1 you can apply for a SSN the same day you arrive in the country, so getting a SSN is the easiest part.

They use fake SSNs. I get those kinds of applicants all the time at work. They're only "caught" by companies who run e-verify, because then they're SSN comes up as not valid. Unfortunately, running e-verify is not a legal requirement so that's how they are able to get jobs with fake SSNs

Uh, I'm talking from personal experience. Thanks. And I've seen a few other long term overstays file and end up getting the notice as well, after they paid for their AOS and had the interview magically cancelled, because the notice was issued prior but they had moved and not updated any address. You dont have to be 'caught' anymore, there is now an electronic visa entry exit system in place, and it is random who they pull and issue NTAs for from this. 

 

I know this because an ICE agent who came to my home told me this when I asked why my husband got an NTA despite not being caught, pulled over, or anything. There was another young lady on here, from Kenya a while back who had this happen as well with filing and finding out she had an NTA on file for overstaying so they cancelled her interview

A previous acquaintance of mine told me that she used her mother's SSN number to get a job (they share the same name).
