K1 - Married less then a week abandoned marriage

Timeline

Once again history repeats itself, uses the K1, and after a short time want to separate, the government should see it with a cheat, people who are CR1 wait months for rediscover their families.

It's hard for her to adjust without any proof of Domestic Violence. USCIS has heard all these stories,probably, thousand times.

It sounds to me like she is the one abusing her husband and gaming the system. I've seen cases where the immigrant partner all of a sudden acquires new vocabulary in domestic violence law. Clearly there are lawyers out there making money on these.

But then again if he wanted sexual reward to which she was not fully consenting, that may make him look very bad in the eyes of the law too. It's hard to separate reality from fiction when her motifs are so obviously unrelated to actual marriage. She should go back to DR before her I-94 expires and drop the whole thing. It's deeply disturbing.

11/04/2016 I-140/485 cases transferred from Nebraska to TCS
12/01/2016 Prepared package for EAD/AP renewal (expires 04/09/2017)
12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE
12/21/2017 Response to RFE received by USCIS 
02/09/2018 I-485 approval (text, email) :)
02/08/2018 I-485 approval notice issued (the "welcome letter") - I'm LPR now
02/16/2018 Green card received
 
11/14/2022 Filed N-400 online; receipt and biometrics reuse form received online
03/07/2023 N-400 Interview scheduled 
04/xx/2023 N-400 approved, same-day Oath ceremony completed. I'm a US citizen.
05/xx/2023 US passport in hand

I agree with everyone...and I told her it was bad. She came got married and someone told her that's all she needed.

She left. She was told she can AOS on her own.

I shown her all the replies of basically what I told her and honestly in DR a lot of people get here and dump the USC never seen it in a week.

I don't know if he did force her to do anything it seems he wanted to have relations with his wife like any normal person and she refused he insisted till she gave in. But I d k I'm an outsider just thought it sounds suspect.

I will let her know to leave once visa expires not sure if she will.

This is very sad because if she stays in this country after her visa expires then when she is caught illegally without green card and get deported back to her home then she is most likely going to be banned from the USA of ever coming back here....but what i think happened is that she met this older man who was stable financially and she was young and most likely was not attracted to him sexually but saw her only way here....it happens all the time but we are only hearing one side to this story...but she must know that if everything is not done according to the laws of the K1 visa then she is at risk of being banned from the USA for fraud because the K1 visa is a conditional (promise) visa and everyone here knows that....for her AOS has not even been done and processed yet and your friend is at risk of being banned if caught...marrying a US citizen is not all she needs to do in order to be here in the states its a process and she stopped at the beginning level of the K 1 visa...and she can't use DUI as a way out because that was discussed in her K1 interview im sure because she knew that before marrying him and the immigration lawyer will look at that as well...but if he give her money for clothes then you have to wonder because a person that verbally abuse their spouse or mate they usually do not take interests in how they look or dress....hope all is well

this is true I have told her the same. I met her in a FB K1 group and she's a very pretty girl and her husband is older but also a very nice man from the looks of things.

I am an outsider just trying to let her know her options.

I unfortunately am limited into helping her anyway because I am going through my own K1 journey lucky for me my spouse did not leave in a week.

I am afraid of associating too much with her as she wanted to come stay in my home since she has no where to go.

and I cant help her I cant subject my case to help her.

First you said he threw her out on the street. Then you said she left and then took money and left. She came here believing all she had to do was marry him, claim abuse, and she could still adjust. Guess she'll be finding out the hard way. Make that 11 million +1 illegal immigrants in the country.

yup she says I married him on Saturday the 8th and he forced me out of the house on the 9th.

however she has no one in Texas and she managed to buy a plane ticket (her cousin) to come to NYC.

I met her in a K1 FB group and I believe she states someone on there and her cousin told her she can adjust without spouse which I told her she couldn't.

the reasons she gave me for abuse were:

1-hes only a plumber

2-he made her eat American food

3-and he wouldn't let her sleep because he wanted adult time.

I never heard he forced her to have adult time or to eat.

I told her I would post so she can see I am telling her the truth but shes not listening to me and wanted to come stay in my home.

I cannot have an illegal person in my home especially since im doing everything right in my own relationship and don't want it to jeopardize me and my case.

my husband also says since he's from DR (and knows how woman there can be) he doesn't want her in the home....god forbid she try and say he did something to her since she claims abuse so easily.

and he wants no problems with our marriage.

Why did she fly to New York, of all places?

She sounds like a complete user. If I were you, I'd even stop trying to help her. Let her make her own mistakes and keep yourself out of it. Let her cousin buy her a plane ticket home to the DR.

Hopefully her "husband" files for an annulment.

Probably because NY is more welcoming than Texas, I'd assume. She probably already knows other people there and can integrate into a community more easily and decide to stay illegally.
