I'm disappointed my wife was denied the visa again. This is our second time, first was the k1 now the cr1 both unsuccessful. I plan to make a couple more visits and then file again with more evidence. Maybe have a baby as well . Seems like the only choice I have to prove to them we are genuine. They said they don't believe how we met. Thanks to everyone who helped out .

1/18/2016 paid aos fee

1/28/2016 review 261 to get iv fee unlocked ( unlocked once I did review,was taking to long)

2/1/ 2016 sent AOS & IV packets together to nvc while I waited for iv fee to open to save time.

2/4/2016 paid IV Fee and waited to do ds260

2/3/2016 nvc received aos and iv packets(scan date)

2/7/2016 ds260 completed and now waiting for cc

I'm sorry for the denial, but unless you can change their minds on why your wife was denied that denial will stand. You must absolutely must clear up that denial, a baby sure the heck will not change their minds.

I am sorry of the denial; I agree with the others that a baby won't change anything. To be crude, it shows you had sex for one night, nothing more.

It seems they don't doubt your relationship so much as how you met. What is unusual about that/ what might they be suspicious about? Details on that may mean we can help you better. For example, you woudl proceed differently if the issue was that you are family, or if a relative of hers introduced you and happened to gie you moeny for an unrelated thing around the same time....

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I'm sorry but anyone can have a baby with anyone?? This is my wife we're talking about. Someone who I've run immigration papers for not once but twice. I've visited her 4 times now , about a month each time. Loads of pictures together. With her family. Text records Skype western union transactions. So I think having a baby would have an impact on their opinion as to if we're real or fake. But no this is my wife. We met through our parents, her mom and dad and my father. They grew up together and introduced us in 2012. I loved everything about her and decided this is who I wanna be with for the rest of my life. I loaded our petition with pics of our wedding texts everyday from the day we met to now.

Please clarify : You said you were denied, do you mean the consulate returned your petition back to USCIS and USCIS denied it ?

The embassy will return your petition to USCIS when they refuse a CR/IR visa, K1's get returned, expire and die.

A spousal petition can NOT be denied by the embassy, only USCIS can deny it. Before USCIS denies a petition they will send you a
NOID/NOIR letter and you can submit your old and new evidence rebuttal. If USCIS is satisfied with your rebuttal then they send it again to the embassy

with recommendation to approve, often they will send it back to the embassy without a NOID/NOIR for you to respond to.
If you receive one you must answer it or will be denied.

There is no reason for you to re file. By all means visit as it will strengthen your case. A child in your eyes helps but not in the eyes of a CO, I also

don't recommend this, why not start the child off with both parents being stable and together under one roof ?
A child deserves more than being put on this earth to convince a CO for immigration purposes.
It is hard enough raising a child and even more so without a father around to participate in the daily responsibilities.

What you need to focus on now is to find the reason of why they didn't like how you met.
What exactly does it say on her 221g letter the CO gave her ?
They probably think it's an arranged marriage not based on genuine love for one another. Get in their head and convince them.

Cambodia is not an easy embassy.

Prepare your rebuttal now for a potential NOID/NOIR letter and add your future visit(s) proof.

In a nut shell : the good news is no re filing needed and the bad news is this wait in queue can take 6-12+ months.

If you are bona fide then you will get eventually get an approval.

July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Ok, no one is trying to be derogatory they are just stating a point to you. No one at USCIS will see that having a baby is any kind of proof.

Based on your reply, you sent pictures and texts; those don't constitute the level of proof needed. They want passport stamps, boarding passes, receipts (such as hotel) that put you two together. Pictures and texts are supporting to the primary evidence needed.

And if having a baby is required for proof of a bona fide relationship, those of us who cannot have children or who are too old to have children wouldn't stand a chance!

Having children doesn't proof a relationship, just as not having children doesn't disprove a relationship. Do you have affidavits from people regarding how you met? I mean, not from your family members? I know they don't normally carry much weight but anything is worth a try and anything is better than bringing a baby into the mess.
