I am inquiring into the whole process of applying for the k-1 fiance visa. A friend of mine who is Filipino told me that anyone above the age of 21 cannot get a visa? (he is much older and perhaps this is old information so perhaps this isn't correct)Can anyone verify that this is true or not true? The girl I am going to ask to marry me is 20 but I am concerned with this whole process taking so long that if this is the case it might be past her 21st birthday!!

Anyone know for sure or who to talk to get this 100 % verified? I tried to call the US embassy of Manila but they refused to talk to me unless I give them her passport info etc...which she won't have until after I ask her to marry me.

I am trying to get ahead of the game and inquire upon everything. I think it would be a very sad story if I go through this whole process with trying to marry her and get this visa and then in the end she ends up being to old to get it and then we can't marry.

That would be a stupid rule if it were true (it isn't).

In this case rule #1 should be - Don't listen to your friend, as that is totally false information.

Only requirement is being legally free to marry, which would mean being age of consent (or parental consent).

I find this rumor to be particularly sickening. People, presumably women, expire at 21. Okay.

Not true.

I believe if your marry someone in the Philippines and she is under 24 you should have a letter of consent from the parents. Now im not sure if that rule applies if you marry in the phil or if it also applies for the k-1 visa but either way you can get married.

No such rule in the Philippines. I married my wife there, she was 19 at the time. Parents did not have to consent.

No such rule about being too old to contract marriage in the Philippines. From 18 to 21 consent from the Parents, or Legal Guardian is required before marriage license can be legally issued. From 22 to 24 advice must be given by the Parents, or Legal Guardian. Advice letter basically states that the Parents or Legal Guardian is aware of the marriage. Family Code of the Philippines, Sections 14 and 15 refer.

There's no upper age limit for the K1. The 21 years of age limit is for K2s, i.e. unmarried children of K1 visa holders. That may be what your friend was referring to.

Yes, I believe this friend was misunderstanding and speaking of the K-2 visa and not the K-1. You must be an unmarried child under 21 in order to receive a K-2 visa and enter the US via a K-1 entrant parent.

Thank you all for your thoughts and information on this. It is clear that my friend was just speaking from experience and didn't realize not all visa's have the same criteria. I am completely relieved however that there is no such age restriction. Like I said, it would have really sucked if she passed age 21 and I couldn't marry her. It seemed like an outrageous rule but I don't put outrageous past any government. My heart is settled and now I can set my heartheart.gif on working out the rest of the application process and my proposal to her!! I Love her so much and am very excited about this news!
