False claim to us citizen question

I been living in the US for about 27 years now and am still illegal due to several issues.

To make long story short I came here when I was 16 YO.

I got married to a US citizen in 1992, have US citizen 2 daughters

In 2002 an attorney used a hardship waiver to bringe me into the US legally

I had about 3 or 4 appointments at the Juarez Consulate in Mexico

On the last appointment the consular officer said the I had admitted to her that I claimed US citizenship to re-enter several times into the US.

I responded that I did not say such a thing, my English then was a little broken, and we argued back and forth to no avail

She just said: "you are now inadmissible in the the US for false claim", then motioned her hand to the next person in the line and said "next"

When she said that, Mine and my wife's world fell apart

Since then I re-entered illegally to reunite with my family but I don't know what to do

Question: are any of you familiar with a case such as mine? what can be done in this case?

unfortunately it is in the system and there is no waiver for that, unless Congress changes the law, there is nothing you can do

it's their word against yours and clearly they have decided that you have said, even if you didn't. that you claimed to be a USC

Well, to begin with, have you ever claimed US citizenship in order to enter the US? Where did the CO get this idea if it never happened and you never said such a thing to her?

Find an amazing (read: expensive) immigration lawyer but know from the outset that there probably isn't much that can be done.

A false claim of US citizenship made after 1996 is a lifetime bar from the US for which there is no waiver available. Since you've EWI'd you may also have a 9C bar in addition.

Long story short, you are likely permanently inadmissible to the US.

The CO officer got this idea because she saw that my passport was renewed at an embassy inside the US not my actual country of origin. So she asked me how I was getting in? I replied that I was being smuggled in by someone else inside their car. I looks like It seemed logical to her that I had to admit to us citizenship in order to get in

That's where she said that I admitted to her that I came in with inspection and claimed US citizenship to get though, which is not what happen and NOT what I said.

I feel that after 4 appointments to establish documentation to get visa approved, more questions popped up, and it seems like they just wanted to find a reason to deny me

Will this case be tried by going to court? applying, for at the consulate? I'm kind of lost in this process.

You can dispute the claim that you never said you were a USC but your history will be used against you.

To be blun, it doesn't look good for you ESPECIALLY with the new administration coming into the White House. You will likely continue being illegal for a long time. Even if you have tons of money for a good lawyer there is still a lot that needs to happen.

Breaking the law YET again entering illegal....does not look good. especially since you know you are banned...

So you entered the US illegally once... then you thought that doing it again its going to be a good idea? And I'm sorry, I don't believe a story that the officials got the idea of you claiming to be a citizen from nowhere. With the new president, there is probably 0 chance of you being legally in this country. Furthermore, if you ever get noticed by immigration or even if the police stops you for whatever reason, there is a bit chance you will get deported again.

Wow, 27 years illegally in the US. I'm assuming you've been working, paying taxes, driver's license etc during this time? The US system really is broken when someone can stay on the radar, illegally for 27 years...

Anyhow. Has anyone been trough this issue?

There are waivers that can be applied for the overstay.

For you claiming to be a USC as of now there's non.

And if there were sometime of waiver....you entered again illegally showing you will continue to break the US laws.

The first entry could be waived but you obviously could care less about our laws.

She's probably assuming that if you were in the car with USC's when coming in, at some point you must have said "Yeah I'm from here" or something along those lines. Now if you had said you were being smuggled in the trunk and added in details of never being able to talk to a CBP officer, she may not have jumped to a conclusion that the only way you came in multiple times was by saying you're from there.

With that said, if she said that, then it's in the system to not let you in the US again. Straight up, no questions asked. You can't prove what you did or did not say, but what they say was said, REGARDLESS if it was said or not, trumps your word any day.

I'm sorry but the path for you to be in the US has ended.

The fact you managed to get BACK illegally into the US after being marked as inadmissible after spending 27 years of coming in and out illegally is one of the things that's wrong with our immigration system.
