  1. You have not provided enough information to know if your Lawyer is right or wrong. I would assume the Lawyer knowing your Immigration History is right, begs the question if you do not trust your Lawyer why are you using that Lawyer? The other option would be to file a Writ of Mandamus to progress your Asylum Claim.

  9. You have not answered the questions, a B1 is for her to attend business meetings etc, a B2 is for visiting. Seems unlikely but no harm trying. If they think she may be intending to work illegally on a B then that would be a major negative.

Au pairs and companions in good standing may apply for an extension of stay to continue participation in the program for an additional 6, 9 or 12 months. The timeline you mentioned does not match the normal J1 situation, did she apply for an extension and for how long. When she applied for an F1 what was she looking to study?

  12. You will be doing the normal Consulate process, I think you may be referring to Direct Consulate Filing which is unusual and not your situation. Otherwise my educated guess would be 18 months.   18. I did not go that way, but I think the I 551 is all they need immigration wise, plus proof of identity and residency. Most States issue a list showing what is required.
