  1. To state the obvious she swore under oath twice that she was married. Probably does not help that you did not know, questions the relationship. I assume they returned the case to USCIS as they approved the I 130 not knowing about these issues. There are two options in my mind. Refile an I 130 being upfront about her past situation. File a Writ of Mandamus to get action on the current case. Either way this is going to be a long and expensive process with possibly an insoluble road block. I would also be working on a plan B.
  2. Normally a Consulate would issue a RFE for the missing document, in this case the Divorce Certificate from the prior marriage. If they believe that she was not married previously then they would refuse the visa bot give the opportunity of filing a waiver, most well prepared waivers are approved. I do not think I have heard of a case being returned, well not for this reason, certainly for other reasons. Do you know why the case was returned. Which Consulate?
  3. There are a lot of Consulates out there and I am most familiar with London and they seem to have a lot of cases like this, can not comment on others.
  4. Unlikely, the Medical is where this comes up. What did the Doctor do?
  5. Forget about the B, VWP is much more practical.
  6. I am not an Immigration Lawyer by any stretch but know a now ex Immigration Judge (retired), went to his retirement do, very interesting. So the one thing that was very apparent, and now this is Denver but I would place a quite reasonable amount on it being the same elsewhere, is that they all seemed to know each other, they deal with each other most days and it is for them a Job, Business nothing personal. So I would use a Lawyer who was well versed with the local USCIS office, knows the head honcho, has been to the sort of event I went to numerous times, and see if they can get it sorted on the basis of we really do not want to do this but here is the brief and if we can not sort out amicably we will see you in Court and it is going to be embarrassing. I only know one ex IJ and no current ones and seriously doubt he would have any time for this.
  7. Unlikely the OP qualifies but we are seeing more and more VJ members going the EB2 NIW route.
  8. https://www.cnn.com/2024/01/08/americas/the-walking-route-how-an-underground-industry-is-helping-migrants-flee-china-for-the-us/index.html Bundled in hoodies and jackets, they huddled around fires as they, and others there, counted the time before US border control agents would take them away for processing – and what they hoped would be the start to their lives in America. These arrivals are part of a staggering new trend. In the first 11 months of 2023, more than 31,000 Chinese citizens were picked up by law enforcement crossing illegally into the US from Mexico, government data shows – compared with an average of roughly 1,500 per year over the preceding decade. For $9,000 to $12,000, travelers can pay smugglers to arrange transportation for parts of the journey north, as well as a boat and guide for the optional rainforest crossing, all inclusive. For those able to spend more, at least $20,000, the route gets easier: for example, help with a multiple-entry visa to Japan, which unlocks visa-free entry to Mexico, and transport to the border. It’s not clear how many are taking those curated routes, but the offerings suggest a range of economic backgrounds among the border-bound. CNN compiled the information on these options by speaking with smugglers and others familiar with the industry, as well as from information in online tutorials. Those from China who travel overland typically take what’s become a well-worn route from Quito to Tulcan, a small city perched on the border with Colombia. There, residents told CNN they see hundreds – if not thousands – of Chinese migrants passing from Ecuador to Colombia each week.
  9. 10 months to a year would be normal, you can find exceptions above or below. Plenty of posts about the data on the web site, most people end up in your case is taking longer than normal.
  10. I stopped receiving emails from them sometime ago, that explains it, sort of surprised as it seemed a logical business. With good margins.
  11. Photo identification (e.g. driving licence, passport); 4 photographs which meet Department of State requirements; For applicants aged 16 and over, a UK police certificate (known as an ACRO) issued within the past 24 months; Vaccination records, which can be obtained from your regular healthcare provider. If you are unable to obtain your vaccination record, you should consult with the panel physician at the time of your appointment. The vaccination chart is available here, as a PDF (187Kb); Completed medical questionnaire, which can be downloaded here, as a PDF (1 page). I assume for the Medical they are looking for DUIs ot Drug related crimes even though they ask for that information anyway. The date of the medical determines the expiration of the visa.
  12. They are not related.
  13. I have not really followed it, only thing I have seen implied is his age.
  14. Your visa will expire 6 months after the medical
  15. Seems his parents are Polish and moved to the UK and he was born in the UK
  16. Close but not quite. He will be 70 for the next election so makes sense. I think he has been around for as long as I remember.
  17. Do you have a B Visa Being eligible for the Lottery may have been a one off, no way of knowing now. Further education in the US for example a Degree in IT or Medicine may open doors. There is the Investment option if you have lots of money
