IoptimisticOne got a reaction from AKN2 in Spouse lied on previous ds-160, iR1 interview coming soon.
Well, my husband went for the interview and he was not asked about his previous visa applications. Thankfully. He was asked a few questions and his visa was approved, as of today, visa is issued. Thanks for the help everyone.

I can’t even follow what is going on.
Sounds like immigration fraud / material misrepresentation to me. Thus …
Until the birth certificates are corrected my advice for all concerned parties is to stay away from the situation or be prepared to be arrested and convicted for felony perjury.
Don’t do the crime if you can’t do the time.
There is no dilemma here.

If the consulate does not accept direct filing of the I-130, requesting expedites at USCIS and NVC stages would also be an option.

I would see if the consulate will accept direct filing of the I130 for the newborn. It is a little complicated since you are awaiting regular processing for the other children, but it might be possible if you have a need to relocate back to the US relatively soon.
Good Luck!

This letter looks like a scam. The letter contains grammatical errors, and the punctuation is suspect. Are they (you) trying to get an H1-B visa? Have you Googled "William Michael Ridgley" and "Mrs. William Gloria" and the company, and looked for scam alerts? Who approached whom in regard to this job? What country are you in/from?

Abuse does not have to be physical. It can be emotional, it can be mental. Luckily VAWA I also considers what the perception of the self petitioner is . If my partner wouldn’t introduce me as their wife, wouldn’t sleep at home, had another woman as their screen saver that they “didn’t know”, and that woman they didn’t know ended up being their wife, I would feel emotionally abused.
However , you are right in the sense that it’s up to the OP to determine if they were abused. But there are options.

IoptimisticOne got a reaction from OldUser in Just done i751 interview and case being held to review
After you send in the court certified divorce document and you don’t hear anything from them after say a month. You have to be very proactive and try to get an info pass appointment at the same field office you had your interview. Especially since you submitted the I-751 since 2018. You’ve waited enough!

IoptimisticOne got a reaction from SalishSea in NVC sent case back to USCIS
When you filled out the I-129f, did you choose a country embassy/consulate in the petition where you want your petition to be processed? Since your petition number starts with a WAC……., nvc cannot process it. If that’s the case, I think their might be hope to salvage your petition. Get on it with the help of the U.S citizen’s senator and a lawyer. There might be hope!

Already asking for help from senator only three months after filing? Wow. You may need to learn some patience.

To begin with. I am so sorry you are going through this pain and disappointment.
I noticed it took 17months for your petition to be approved, that’s very unusual, did you get an RFE while the case was with USCIS? If you did, what was the RFE about?
Also, for NVC to return your petition, I think there was an error on the part of USCIS in approving the petition and NVC had to return it. If you guys never had an interview at the u.s consulate then I can only imagine your confusion as to why it was sent back.
You can contact nvc through their portal since calls are no longer allowed; but you won’t get a response for months. I’d also recommend the USCIS partner to contact his/her senator for help ASAP because you need to know what went wrong before filing another k1 or cr1 petition - so that you don’t repeat the same mistake.

Your documentation is all
online. Most application are now. No packet to carry as the CBP officer at entry will access it electronically.. trust me .. be thankful you don't have to carry that dreaded yellow envelope and guard it with your life !!

IoptimisticOne reacted to OldUser in Citizenship Interview Question
If it's a combo interview, I-751 can be denied because of USC wasn't present. Would you want to spend $$$$ and few years again waiting for approval? This is literally one of the most important days for an immigrant. Spend $50/$100 or whatever for somebody to look after the dog if needed. The cost is miniscule in comparison to benefits of I-751 approval.
P.S. you cannot tell whether it's going to be a combo interview or just N-400. There's no way of knowing it upfront in your case. Assume USC must be there.

I have heard that It has been stated by immigration officials that there are 3 levels of difficult consulates:
Low difficulty
High difficulty
Lagos.

dogs will be cared for by the airport while they , themselves , go thru security checks for any illnesses
your wife will not get them till they are released from quarantine so not an issue
she will only have her luggage as your luggage must remain with u for your own security checks
Probably they take u into together for questions
Get an airport cart to handle the luggage

No doubt it has happened to somebody but certainly in the last few years I have not seen somebody referred to an IJ.
SB1 is much easier to comment on, you sold everything etc, headed out been gone for 3 years, did you retain anything in the US?, you make it sound like you just moved.

Please don't be so rude, would be nice for a friendlier answer like "Sorry man but that information is wrong, here is the correct information"
Why does it feel like everyone on this forum is trying to 1 up others and have a general negative demeanor towards everyone. My answer was based on data from this very website for F4 classes as well as USCIS. I do know that NVC is currently backlogged all the way to 2007-8 for F4 cases but again there's no need to be so hostil.
Could you tell me if this screenshot from travel.gov is not evidence of health needs for grounds to expedite for immigrant visas for benficiaries? If so, i'd love to know more.
Thank you.

IoptimisticOne reacted to geowrian in IR1 Visa refusal
If the visa was only refused due to a public charge concern, the petition won't be returned to USCIS and no NOID or NOIR will be issued. That's only if they believe the petition is invalid (i.e. not a bona fide marriage).

Nah not a material fact. If he said he was singled and yet you were married or gave false documents then that would ban entirely different matter

You can apply and just take it that you bought lottery tickets with the application fee. An observant interviewer should catch it though and based on the facts you’ve provided should deny her application. An aggressive officer could attempt to put her in removal proceedings however that’s unlikely.
In reality it appears she’s a long term tourist in the USA 😁.
