TurtleMoss reacted to SusieQQQ in Visitor visa to accompany USC to US for urgent medical treatment
The more times someone goes for an interview the more likely it is to get the same officer more than once. My home consulate only had 2 COs, so if you went three times or more you could not possibly avoid being seen by one of them more than once.

I’d suggest asking for an expedited appointment- might be worth even asking for just a single entry visa so she can do this trip, though the previous denials won’t help and the fact that there is an i130 filed is also a negative.  But if it were me I’d give it a try anyway under the circumstances.

    Good luck with the surgery.

Try a different office ASAP. They aren’t giving you very good information.
The wait 2 weeks is old stuff. Your passport scan at POE populates it immediately.
SAVE should be instant. It sounds like they think SAVE should change.  It’s the manual process of sending off to USCIS that they say allow 4 weeks.

if the USCIS entry record (done by passport scan) does not match exactly, they have to manually verify. If your first and middle name are run together into one long name, you don’t match. See anything like a run together name on you I-94?

Was her marriage to another immigrant?
or to a USC like her?

9 years is not as big an age difference for visa from Morocco
and it is good she did not marry the 1st visit

she can apply as soon as she has the original marriage certificate and a certified English translation

    Now to really help u
    1.  she should join the site and follow the Morocco portal
    2.  she should do a timeline so we can follow the case progress and advise her on any issues she may have
    3.  it will be 18 to 24 months to complete to the interview for your visa if u r approved
    4.  she should try to visit you again before the interview
    5.  she should save boarding passes and proofs of each visit
    5.  u married this year (and this is very important in Morocco) so she needs to fill as married and add u to her 2021 tax returns
please tell her to message and ask how IRS says to do this / important that when married to a Moroccan , we show we have started to commingle fiances

    and Congratiulations

    Practice your English skills
and learn how to drive before u leave Morocco as driving lessons are expensive here so help her save this expense

About two years ago DOS decided to use REFUSED as interim status during processing. Caused a lot of angst. You are looking for issued or denied. Those are final status messages (most of the time).

Also, just a note, the CEAC status can be a bit misleading.  They use the term "Administrative Processing" sometimes, and "Refused" sometimes and they basically mean the same thing.  Refused does not mean denied.

    Good Luck!

Approval is not set until the CEAC status is "issued."   There can be last minute background and security checks, especially for Pakistan.

Plenty of single mothers use daycare, should his visa be denied, you do have solutions - don't be too pessimistic about your training and life in the USA for the next couple of years, you'll manage.

That is when entering with an IR-1. Entering with SB-1 means the conditional LPR status was not abandoned (see INA 101(a)(20)) thus INA 216(c) still applies.

As others have said, Buy the round trip, and just cancel the return leg. I did this when I bought my wife her ticket to come on a K1 and just pushed the return date out as far as possible ( Like 90 Days). There are two good reasons for this, 1 - it's cheaper, 2 - If things go south, you already have a return flight back before the 90 days is up. I know that sounds cold, and I'll probably catch some flaming for it, but you never know, sometimes things don't work out, and your already covered. Also, when you go to cancel, check if you can get a credit if not a refund, and then you will have some credit to use with the airline usually within the next year, but I have heard some airlines have been allowing you to use the credit even further out.

Unfortunately this seems like a case of someone who was very careless (forgot signature, forgot to answer an extremely important question on the form) and therefore when he was finally able to send in a complete package, he had already gone past the mandatory requirement of meeting within 2 years of filing.

He should wait for the denial letter to understand the exact reasons for the denial, and study the process in the meantime.

I also recommend that he create his own VJ account so that he can directly receive answers about his case.

If she’s between 19 and 49 she will only need the following:
Td or Tdap MMR Varicella (either shot or history) Influenza (seasonal) Its not required to have vaccines completed to pass K1 medical but I strongly suggest you do them because it’s required for adjustment of status once she gets here. It’s very difficult to find a USCIS designated civil surgeon here in the US who will agree to transcribe vaccinations only, they will make you go through another medical to make money off of you.

Last month, I had three vaccines for seven different diseases done on the same day: TDAP, MMR and varicella. I had no side effects and found it amusing to have three different bandaids on my arms for a day.

It's also normal for kids to have had multiple vaccines done during doctor visits without any problems.

The first comment explained it very well for you or whoever this is for. Please understand that lawyers do not guarantee approval or eliminates any application mistakes. Lawyers mess up just like anyone else could.

VJ members typically only recommend lawyers if there are any barriers that prevent the issuance of a visa.

The applicant needs to find out first why the USCIS denied the application in the early stages of the process. Once that is clear, you can come back here and let us know and we can help you how to go from there.

TurtleMoss got a reaction from JeanneAdil in how soon can a green card holder bring her husband to america?
You can file an I-130 for your husband when you are legally married. The process to adjudicate I-130 petitions for spouses of lawful permanent residents generally take longer. Don't expect this to be a short process. I-130's filed by LPR's take longer to adjudicate than I-130's filed by US Citizens. Last time I checked the process takes about 2ish years.

The I-130 is approved correct?  Where exactly in the process is your case?  NVC possibly?

When I had my F-1 questioning it was made very clear to me that I was expected to demonstrate non-immigrant intent since the whole purpose of an F-1 visa is non-immigrant.  How does your son intend to show the officers that he intends to return to your home county once his studies are completed?

I understand that your son deserves this, but I went to University at the age of 41.  It is never too late for him to chase his dreams.

    What a waste of paper....
My ROC packet was probably 1/10 of yours (2 years worth of bank statements?! sheesh...) and I got approved without an interview.
Not sure why you need to send so many mortgage docs, CC statements, and months worth of other bills. Most recent month in each case should be enough if you must send your pest control bill.

The thing is nothing is stoping you from going to be with your mother nothing is stoping you to return to caring for your children. If you're going to use that as your excuse you need to step it up. You haven't done either of those things in over a year. Then you go on to how you're going to work all these hours so you still won't be the one caring for your children. No a death or dying family is also not reason for expedite or DCF

You need to show why all of a sudden you not your wife needs to be back in the US now. For DCF they want to see why you should qualify for something no longer available. All this is on you not your soon to be wife. If she wasn't in the picture you would be doing it the same way as before with help paying a sitter or your mother. This is why job relocation is usually the only thing besides military has worked.

Try it but  you need to step it up.

You cannot adequately address your RFE.  Best for your response to be a simple signed letter withdrawing your I-129F petition.  Get legally and lawfully "married" however and wherever you find most fits your current circumstances and priorities, then start over with a spouse visa process.

Note" that in the USA, each State handles marriages and divorces, so there is no National registration or database of who is married and who is not.  Not sure what you did to "register your marriage in the USA", because there is no such thing.

You said "and have our civil union registered as a marriage in the US?".  There is no central marriage registration system in the US.  I still suggest marriage outside Italy, and a spousal visa.

The recommendation from your state representative is useless as they are not the ones to adjudicate the petitions.

It is actually not uncommon for one to be too married for a K-1 and not married enough for a Cr-1, it is seen here a lot.  You cannot 'change' however.  If you are able to meet the requirements for a Cr-1 spousal visa you may refile with new fees and new waiting times.  You can see the I-130 instructions and the guides here to see what is required for a Cr-1 visa.

    Good luck.
