    This likely happens a whole lot more than we hear about it on this forum. I vaguely remember a couple of cases in the pass that were along the lines of the OP. This is an extremely difficult and embarrassing situation. I admire the courage of the OP to come here and discuss his options. But it also makes me wonder if he did it to get the 
     
    I want to share a phrase I learned that should help you decide on what to do.... "Don't light yourself on fire to keep someone else warm."
     
    You may love her, desire her, and she has a lot of things you want in a wife. But she may not be for you. You can love someone without being with them. There is no governing, spiritual, or physical law that states you HAVE to marry someone because your love them. Some times people are not good for each other no matter how they feel about each other. I'm all for giving someone a chance if they make a mistake. But this may be something that is beyond restoration in my opinion.
     
    Here are things to consider:
    You will be responsible for her and the child, even if you two divorce later. It is in the affidavit that you will sign for her. The bio father may want to be in the child's life and could very well have the right to say whether of not the child can leave the country. Having a child is stressful for any relationship. You two would be going from young loving newlyweds to a full family with huge responsibility and trust issues. You will not have given your marriage enough time to develop. The baby will multiply your financial expenses 10 fold. You don't seem the know the true nature of your fiance and the biofather's relationship. From your follow up post it seems you have little information about him. She may had some serious feelings for him now. Obviously, she has some feelings with him if she produced a child with him. But it could very well be more than a fling. This situation will put an extremely negative variable in your relationship. Immigration issues, assimilation issues, and financial issues are already waiting to put a burden on your relationship. Now you have to deal with trust and uncertainty. To answer your question, it is possible for you to go through with the K1. But there may be some tough questions during the interview. If you are there during the interview (and I HIGHLY suggest you be at the interview if you move forward with this), she will need to be 100% truthful. The interview is not the time for surprises to pop up. And those officers may ask some really tough questions.
     
     
    At 31 y/o, you have to realize that life is just now starting for you. Don't start it off on the wrong foot. You have a choice to direct the path you want to take. You can start a successful business or backpack around the world if you wanted to. You can still care for her and be there as a friend to her. 
     
    If you do decide to continue... at least make the choice to delay the interview. Tell her you need some time before move forward. Give yourself a few months or even a year before finishing the process.
     
    I truly wish you the best of luck. And if I knew you personally, I would have a case of whatever your favorite beverage waiting for you.

    There's no quarantine for dogs coming into the US. My cat flew with me from Aus to US in June. The hardest part is finding a spot on a flight for your pet during Covid. I would recommend you looking into it early because there aren't many flights flying between the AUS and US. You might also want to get your dog their rabies shot if they haven't, as some airlines require it.

    I don't know how or why but I got an email from the NVC last night that my K1 case has left the NVC!!  I'm dancing, I'm crying, I'm elated!!  confirmed on the ceac website just now that it shows as 'in transit'.  Not sure what changed, but I'm beyond excited right now!!  Just gotta sit tight and wait for it to hit the consulate and get the interview date to book the medical...  Hopefully this is a sign that they are starting to process K1 visas at Sydney along with spousal visas!!!

If you have been able to, could you please put down the earliest date that you have been able to book in with? Just to give everyone an idea of how big the backlog is/ expected timeline.

    A pamphlet and a class don't prevent domestic violence from happening. She may remember from the class what she's supposed to do, but she may be unable to do so. 
     
    I understand you prefer to stay out of people's business, but this is not about just anyone. This is a friend that she is concerned about. There is nothing wrong with asking for a welfare check.

    Please call the non-emergency line of her local police department and ask them to do a wellness check.   You don’t have to reveal any details: the fact that her friends and family have not heard from her is enough for the police to do a check.

    That's a good policy but if she ends up dead or missing I don't want to know that I could have done something and didn't.

    Stay out of this.  You have no proof.  Let USCIS deal with if they apply for AOS.

    I would feel the same way.
    I’m sure most people would even the people who scream ‘fraud’ in your face 😴 but it’s been and gone and there is no point in dwelling on on the past 😊
    Your allowed too be upset about the situation. On the bright side Your application is in and you’ll get there one day ❤️

    Filing for AOS while in the US on nonimmigrant visas is not committing fraud. If the OP now enters the US with intent to marry and file AOS, that would be a fraud.
     
    To the OP:
    Yes you could have done that but as others have said, past is past and hope you will immigrate to the US soon.

    @Claire1212 No sense in kicking yourself while you're down.....You can't change the past so it's best to be optimistic for the future! You'll be together one day. It may not be as quickly as you want, but it will happen. That's what I tell myself everyday while waiting on our K1 too. ❤️

    I am not trying to bring anyone down by posting this. I know how excited everyone is who received their NOA1 in February. Please, for your and your fiance's sanity, please keep in mind that as of this day the date they have listed as "outside normal processing times" is December 01, 2019.  Only those who received their NOA1 on or before this date would be considered "outside normal processing times". Technically speaking, I would venture to say that all of the approvals we have seen so far are actually getting their NOA2's before even entering the "normal processing times" from the USCIS.  "Normal processing times" are 5-7 months from NOA1. 5 months ago would be January 30, 2020. Keep your chin up. Your approvals will come. I wish I could give anyone who is discouraged a big hug. This right now is completely out of our control. 💕

    If your fiancé can access the mail regularly, then it wouldn’t be an issue and change it during the next steps.

    The whole process will  be slow regardless of how fast the USCIS process your NOA1, this will be due to the backlog now forming at the NVC since embassies are not processing K1's at this time expect those getting an emergency exemption.  
    But a tiny positive we have is the Sydney embassy seems to be at phase I of resuming normal operation, but with how Australia is travelling they should be at phase III in no time (Victoria needs to pull its together to make this happen)

     At the rate things are going for February Filers! I'm going to call it; our first APPROVAL will come in AUGUST, latest!! 🙌🤞🙏

    we will only be there until April and he is getting out. We will be going to Maryland. I am more nervous about that lol!

    You shouldn't worry because it will be routed to the right place. At least it was the same country and you didn't put the wrong country in it. 
     
    Side not..... So is your fiancé a Marine stationed at CP? If so you will like the area just stay away from Oceanside if you can
