Sparkey got a reaction from Family in Husband threatening with deportation
Thank you. I am safe. He has never touched me. Just working on getting out of my situation now.

He told the cops he did it to get a rise out of me. They were not impressed. His parents are 100% aware of the situation but are no help at all. I just know I can't stay in this situation anymore. I need to look out for myself as well.

Threats of suicide, and of ruining your immigration journey/life as you know it, are still part of a violence pattern. Leaving is often when this escalate; the website has good tips on how to leave safely. Also, good tips on what documents to gather (add what will be needed for you to remove conditions, as much as you can).

He cannot affect your immigration status.
You can document the threats he has made and consult a divorce attorney.

I would like to add to this. You know what your life has been and you know him. Think long and hard about everything you have been through.
If he has been showing any type of emotional or psychological abuse he may be using suicide as phycological abuse. I've been there and it happens and it worked on me. That is until I drove him to the locks where he said he would jump. I don't ever recommend you do this but I was in that marriage for 15yrs.
It's good you called 911. Be very careful, as the threat of deportation can also be more psychological abuse.

He cannot do a thing. Gather all the documentation/evidence that the marriage was in good faith... this will make the removal of conditions process way easier. Pretty much keep evidence of EVERYTHING and try to keep it in a safe place and with someone who you can trust. Get a lawyer and file for divorce, good luck with everything, i wish you the best.

Sparkey got a reaction from Family in Help! Interview cancelled and NOID
I called USCIS today. I am 100% allowed to and encouraged to upload the document to my account. I received the NOID and then upload the document. They confirmed that I did it correctly.

Thanks! Hoping they waive the interview altogether now that it's been cancelled, but if not, we have a mountain of joint evidence to bring to the interview.

The dates listed are the dates on the paper copies I received in the mail.
I also mailed in a copy of the MC yesterday.

I can already see the notice of interview cancelation in my USCIS My Account Documents tab. The letter says 'This is to advise you that, as requested, we have cancelled your interview on July 21st....'.
Yes, we married in the 90 days.
No, he did not cancel the interview.

Sparkey reacted to HRQX in Remote work income from non-US company caused RFIE
Not a gray area. INA 245(c)(2) and INA 245(c)(8) is explicitly clear. OP's I-485 won't be denied for the unauthorized work. I-130 is not needed in OP's case.
The reason an I-130 is needed when a couple marries after the 90th day is because INA 101(a)(15)(K)(i) requirement was not met. Totally different scenario than OP's case.
@art95, a properly completed (i.e. the foreign income excluded) I-864 (or I-864A) must now be submitted per 8 CFR § 213a.2(c)(1)(i)(C).

Sparkey reacted to Loki_Go in Experiences? K1 working for foreign company while waiting AOS
I'm interested in where you're drawing your conclusions from. Working remotely is a grey area and has been for years.
Do you have specific experience? Were you rejected? To be honest, I feel a lot of people saying it's not possible have no real idea if it is or not. I did this, I still am, it came up
in my AOS interview and there was no violation of the terms of my AOS. It's also NOT visa fraud. Stop perpetuating this fear. In fact, working illegally is forgiven at the AOS stage (as are overstays).
I did it. It's entirely possible (for now).

Sparkey got a reaction from PatLuvO in K1 AOS from outside US?
Me and my fiance are going through the K1 process (almost done). If i entered the US on a K1 and got married, would I be able to return home and file for AOS from outside the US?
Ideally I would want to come back to Canada until I am able to work in the US.

Sparkey reacted to payxibka in K1 - Police Certificate
Be careful giving generic answers.. Canada is not Indonesia. They have a very specific PC to request for the interview. If you get the wrong one, you will not be approved and receive a 221g at your interview.

Sparkey got a reaction from SETETA in Changing from K1 to CR1
On the K1, the AoS (adjustment of status) is only filled out after we would get married. Then there is a wait of about 6-8 months for that to be approved. During that time, I would not be able to work or leave the US.
So far, all we've done is passed the USCIS and NVC phase. The paperwork is at the embassy and I'm waiting for packet 3 to be sent to me so I can fill out the DS-160 and gather everthing for my medical and interview.

Sparkey reacted to Dashinka in Changing from K1 to CR1
Most folks find the CR1 to be a superior visa particularly for the work related aspect as you mentioned. For those from countries that can easily visit the US (or visa versa), I would certainly recommend the CR1 over the K1. In your situation, personally, I would make the change you are considering especially considering your work. I realize it means a little bit longer wait, it in the end it would most likely work better, and at least you have the ability to visit relatively easily. As to the I864, you fiance/spouse should look at trying to find a co-sponsor just in case his work doesn’t come back immediately.
Good Luck!

Sparkey got a reaction from NikLR in Question Re: CR1
Super helpful! Thanks so much.
I guess I should be the one holding onto the original certificate then since I will need it to change my name in my Canadian documents but will also will need the original for the visa interview eventually.

Marry anywhere you want. We were super creative. . . Meet in the Philippines, married in Hong Kong, moved and immigrated from Mexico, Depending on where you marry, it can be easy to get extra certified copies of the marriage certificate.
